If you intend to operate or substantially modify a technical X-ray equipment and it does not require a permit, you are obliged to report this to the competent authority.
With the written notification of a technical X-ray device (type-approved X-ray emitter, basic, high-level, full-protection device or school X-ray device) to the competent authority, you announce that you want to operate such a facility or that you want to make a significant change. You must implement this at least four weeks before the intended start. After the expiry of this period, the X-ray equipment may be operated, unless this is prohibited.
The legal requirements must be met. The necessary documents must be submitted for this purpose.
In addition to the application for notification, the following documents must be submitted:
A) Technical X-ray equipment:
- Copy of the certificate of an officially appointed expert, including the test report
- Imprint of the registration certificate for the design of the X-ray emitter
- Proof that the number of radiation protection officers necessary for the safe operation of the X-ray facility has been appointed and that they have been granted the powers necessary for the performance of their duties
- Proof that each radiation protection officer has the necessary expertise or, if a radiation protection officer is not necessary, the radiation protection officer has the necessary expertise in radiation protection
- Proof that the persons otherwise involved in the operation of the X-ray facility have the necessary knowledge and skills with regard to the possible radiation hazard and the protective measures to be applied
B) Basic, high- or full-protection device or school X-ray equipment:
- Imprint of the registration certificate for the design of the X-ray equipment
- Proof of the quality control carried out with the result that the X-ray equipment complies with the characteristics of the type approval that are essential for radiation protection
- in the case of a basic or high-protection device or a school X-ray facility
- Proof that each radiation protection officer has the necessary specialist knowledge or, if a radiation protection officer is not necessary, the radiation protection officer has the necessary specialist knowledge in radiation protection,
- proof that the persons otherwise involved in the operation of the X-ray facility have the necessary knowledge and skills with regard to the possible radiation hazard and the protective measures to be applied
After the expiry of the four-week period, you may operate the X-ray facility, provided that the procedure has not been suspended or prohibited due to reasons for failure.
You may be prohibited from operating or substantially altering your business if:
- you do not or no longer meet one of the requirements to be demonstrated; this shall only apply after the expiry of the deadline if a remedy is not remedied within a reasonable time
- there are facts from which doubts arise as to the reliability of the person responsible for radiation protection or the radiation protection officer
- there are facts which give rise to doubts as to the availability of the necessary personnel for the safe performance of the activity
- it is an unjustified type of activity or if there are serious doubts as to the justification of the type of activity
- is seriously or repeatedly violated the provisions of this Act or the ordinances issued on the basis of this Act or the orders and orders of the supervisory authorities based thereon and is not remedied within a reasonable time
- this is necessary due to a significant risk to employees, third parties or the general public
- other provisions of public law preclude the intended activity.
The same applies in the event of a significant change in the operation of an X-ray facility
The fee is calculated according to the time spent, but is at least 150 euros.
You must submit the notification form with the required supporting documents to the competent authority no later than four weeks before the planned entry into service or the substantial change in operation.
Upon receipt of the complete notification and the necessary supporting documents, the competent authority shall examine it within four weeks.
After the expiry of this four-week period, you may operate the X-ray facility or significantly change the operation, provided that the authority does not refuse operation and/or suspend the notification procedure because the inspection shows that further test procedures are required.
If the authority informs you in writing that all evidence has been provided, you may operate the X-ray facility as soon as you receive the notification.You will receive the fee notice with the notification confirmation.
