The approval of the tariffs for local rail passenger transport must be applied for at the Lower Saxony Ministry of Economic Affairs, Transport, Building and Digitalisation.

Public railway undertakings are obliged to set tariffs for local rail passenger transport. Tariffs are transport charges and conditions of carriage without the prior authorisation of which rail transport services may not be provided. Fares must include the charges or all the information necessary for calculating the charge for the carriage of passengers and ancillary passenger services, as well as any other provisions governing the carriage. Tariffs must be applied to everyone in the same way.

The railway undertakings as well as the transport and tariff associations based in Lower Saxony submit a tariff application for the conditions of carriage or their amendment to the Lower Saxony Ministry of Economic Affairs, Transport, Construction and Digitalisation, which will be decided on within 6 weeks.

The railway undertaking or the transport or tariff association must have its registered office in Lower Saxony.

An informal request for approval of the Conditions of Carriage or for approval of the amendment of the Conditions of Carriage is submitted. If this is intended to deviate from the provisions of the Railway Traffic Regulations or from agreements or impositions pursuant to Regulation (EC) No. 1370/2007 as amended, special attention must be drawn to this. The application will now be examined to determine whether the tariff exceeds a maximum tariff set in accordance with Article 3(2) or (3) of Regulation (EC) No 1370/2007 and whether the conditions of carriage comply with the applicable law.

The authorisation shall be deemed to have been granted if the applicant does not receive a decision from the licensing authority deviating from the application within six weeks of receipt of the application.

Complaint within one month of notification to the Administrative Court in Lower Saxony.

• The application must be submitted in writing to the Lower Saxony Ministry of Economic Affairs, Transport, Building and Digitalisation.
