If you would like the monument properties of an object to be determined, you can apply for this at the State Office for Monument Protection.

Cultural monuments are architectural monuments, ground monuments, movable monuments and monuments of the history of the earth. They must be protected, cared for and scientifically researched.

In order for an object to be considered a monument, it must possess certain characteristics. In order to check whether it meets the requirements to be placed under monument protection, you must submit an application for the determination of monument status. If the requirements are met and there is a public interest in the preservation of the object, it is considered worthy of a monument. The same applies to the review for the withdrawal of the monument properties.

After examining the facts of the case, the Lower Saxony State Office for the Preservation of Monuments determines whether an object has monument properties. If this is the case, it will be included in the list of cultural monuments.

If you wish to make this request, you must be the owner, authorized representative or person entitled in rem.

• You fill out the application and submit it together with the necessary information and, if necessary, documents.
• The application will be checked for completeness.
• The requirements for determining the monument status of the object are examined.
• If all conditions are met, you will receive a notice or notification of the result of the examination.

There are no deadlines to observe.

The declaratory administrative act merely confirms the legal requirements of a listed building. The action for annulment must therefore be directed against the status of a monument, not against the violation of regulatory provisions.

You can file a lawsuit against the decision in the case of movable monuments and architectural monuments that were included in the list of cultural monuments after 2011 and thus initiate an appeal procedure. In the case of architectural monuments that were included in the register of cultural monuments before 2011, ground monuments and immovable monuments of the earth's history, no declaratory administrative act can be applied for. In this case, a declaratory action must be brought directly before the administrative court.
