You are subject to the verification requirement for hazardous waste and must have a proof of disposal approved? Provided your disposal company is approved for the privileged procedure, your proof becomes valid under federal law without official confirmation.
The disposal, i.e. the recovery or the disposal including the collection and transport of hazardous waste, is subject to a waste law verification procedure. Waste producers as well as owners, transporters, collectors and disposers of hazardous waste are obliged to do so. Private households and small quantity generators who produce no more than two tonnes of hazardous waste per year are exempt.
If the disposer is approved for the privileged process, your certificate becomes valid under federal law without official confirmation. These disposal companies are usually specialist disposal companies and have been given an exemption number for the privileged procedure.
- Prescribed forms of the Ordinance on Waste Recovery and Disposal (Responsible declaration by the producer (DEN, VE, DA), declaration of acceptance (AE))
- including appropriate declaration analysis
Access to the electronic verification procedure via a post office box directly at the Central Coordination Office of the Federal States (ZKS) or via a provider.
An electronic signature card is required for the necessary electronic signature of the verification documents. This signature card is available from various providers.
Tendering procedure: the fee for the treatment, storage or dumping of hazardous waste for disposal shall be calculated on the basis of the expenditure incurred; this is to be increased by 7 per cent to compensate for the expenditure incurred by the Central Office for Hazardous Waste.
Verification procedure: A fee of 50 to 5000 euros may be charged for the issuance or substantial modification of an official confirmation pursuant to § 5 NachwV, also in conjunction with § 9 (3) sentence 1 NachwV, for hazardous waste that is not subject to the statutory obligation to be delivered, according to the applicable cost tariff. This fee is not to be charged in addition to the fee for the tender procedure.
- Preparation of the declaration of responsibility (DEN, VE, DA) by the producer,
- Completion of the declaration of evidence with the declaration of acceptance (AE) of the disposer,
- Submission of the electronic proof to the disposal authority,
The evidence confirmed in the basic procedure and the privileged evidence must be valid at the time of disposal.
According to state law, disposal of waste subject to tender is only possible after submission of the allocation.
Proof can be valid for a maximum of five years.
The deadlines for the disposal company to send the electronic consignment notes are 10 calendar days.
As a rule, the terms of disposal certificates and allocations issued in the tender procedure correspond to each other. In justified cases, the duration of an assignment may be shortened.
You can lodge an objection against notices (e.g. official confirmations, allocation and cost assessment notices) issued by the Central Agency for Hazardous Waste with the Lower Saxony Society for the Final Disposal of Special Waste mbH (NGS) within one month of notification.
