The authority may also order the appointment of a water protection officer in addition to those already obliged to do so.

The competent authority may order that

1. the dischargers of waste water into bodies of water for which there is no obligation to appoint water protection officers in any case
2. the dischargers of waste water into waste water installations
3. the operators of installations for the handling of substances hazardous to water pursuant to section 62 subsection 1 WHG,
4. the operators of pipeline installations pursuant to No. 19.3 of Annex 1 to the Environmental Impact Assessment Act

must appoint one or more water protection officers.

The order is issued by the authority.

The order on the part of the authority is not bound by time limits.

The responsibility lies with the authority, which also issues the permit under water law.

These can be the lower water authorities (districts, independent and large independent cities), the Lower Saxony State Agency for Water Management (NLWKN), the State Trade Inspectorates or the State Office for Mining, Energy and Geology (LBEG).
