If you want to work as an expert in accordance with § 24 DepV for a decommissioned long-term storage facility in accordance with the Landfill Ordinance, you must be appointed (i.e. approved) by the competent authority.

If there is a concern that, after the closure of the long-term storage facility, harmful environmental effects or other hazards, significant disadvantages and significant nuisances for the general public and the neighbourhood within the meaning of Section 5 (3) No. 1 of the Federal Immission Control Act (BImSchG) may be caused, the operator must, at the request of the authorities, have it checked whether the requirements under Section 5 (3) No. 1 BImSchG are met are. These checks shall be carried out by competent persons.

An expert must be approved by the competent authority.

In the case of foreign applicants, exceptions may be made to the following documents, depending on the decision of the competent authority, provided that the expertise and reliability are proven in another way.

The appointment of an expert is made upon request after a review, which is based on § 24 (2) of the Landfill Ordinance (DepV). The required expertise, independence, reliability and technical equipment are checked before the announcement (approval).

Installations required in Lower Saxony:

• Copy of the certificate as an expert according to § 18 of the Federal Soil Protection Act, recognized according to § 2 para. 1 and § 9 of the NBodSUVO. If there is no recognition according to § 18 BBodSchG, the opinion of an expert committee set up at a chamber of commerce or chamber of industry and commerce in Bremen, Hamburg, Mecklenburg-Western Pomerania, Lower Saxony or Schleswig-Holstein for the evaluation of the expertise of an expert according to NBodSUVO must be obtained for the professional assessment of the expertise.
• Certificate of good conduct (document type OG, not older than 3 months)
• Information from the Central Trade Register (document type 9, not older than 3 months)

They have the necessary expertise, independence, reliability and technical equipment.

Fees are charged in accordance with Appendix 1 to Section 1 (1) of the General Schedule of Fees of the State of Lower Saxony (AllGO) in accordance with No. 2.21.26.

You submit an application for appointment as an expert for long-term storage facilities in accordance with § 24 of the Landfill Ordinance (applies to long-term storage). Please attach the required documents. If necessary, the authority will request further application documents. After examination by the competent authority, you will receive a written decision. The provision (authorisation) may be provided with a reservation of revocation, a time limit, conditions, obligations and the reservation of obligations.

There are no deadlines to be observed.

The announcement made in one federal state is valid nationwide.

The permit requirement does not apply if an equivalent permit from another EU or EEA country is presented. This authorisation must be submitted by the expert before commencing work. At the request of the competent authority, the documents must be submitted with a certified translation.

It is possible to lodge an objection in due time.

The objection must be submitted in writing or for transcription to the State Trade Inspectorate Hildesheim, Goslarsche Straße 3, 31134 Hildesheim.

Experts for the inspection of disused long-term storage facilities in accordance with § 24 of the Landfill Ordinance must be approved.

The responsibility lies with the State Trade Inspectorate Hildesheim, insofar as the expert's place of business is in Lower Saxony.
