If you want to offer low-threshold care services to people in need of care, you must first have them recognized. The application for the recognition of offers according to § 45a SGB XI is made individually in the federal state in which the offer is made.

According to § 45b SGB XI, people in need of care in home care are entitled to a relief amount of up to 125 euros per month. Among other things, you can use it for services of the offers for support in everyday life. This includes care, supervision and everyday support for those in need of care, care support and relief for relatives as well as housekeeping services in the immediate vicinity of those in need of care. In this way, people in need of care as well as relatives are to be supported and relieved in coping with their everyday lives in the context of care.

The relief amount is not paid out to those in need of care, but is reimbursed by the long-term care insurance funds against the submission of invoices for care services actually used.

Long-term care insurance funds only settle the relief amount with providers who receive recognition from the state as an offer of support in everyday life or who have a care contract as a care facility or care service with the long-term care insurance fund.

According to state regulations, providers of offers for support in everyday life can receive subsidies, which are granted in equal parts by the state and the associations of long-term care insurance funds.

a) The application for recognition as a low-threshold care offer is made in writing without a form

The following documents must be submitted:

• Concept for a long-term care offer, from which the target group, the scope of the services and the method of care results,
• Proof that the professional guidance, training, continuous accompaniment and support of the volunteers is guaranteed by a specialist, in particular by a nurse, a doctor, a social pedagogue, a special education teacher, a curative education nurse, a curative education nurse, a psychologist with psychiatric, gerontopsychiatric or curative education experience (copy of proof of qualification),
• Proof that the care is provided by helpers who have completed at least 20 hours of training tailored to the care offered on how to deal with the persons to be cared for and who are undergoing further training in this regard (training and further education concept)
• Proof that the provider is adequately insured to cover damage that may arise as a result of the care offered (copy of the insurance policy) and
• in the case of group care: designation of the premises that are available for group care and, if necessary, can be checked for suitability (address).
   

b) Application for funding of the low-threshold offer

1. Acknowledgment:

• Personal and professional suitability of the provider or the emergency services
• They have a concept that states where they may support which target groups with which services (for legal entities and partnerships as well as commercially active individuals).
• You are at least 16 years old, not related or related by marriage to those in need of care, not a caregiver and do not live with them in the same household (for volunteer neighbourhood helpers).
• Remuneration and travel costs are lower than the federal limit according to § 45 b para. 4 SGB XI (for legal entities and partnerships as well as commercially active individuals).
• Expense allowance does not exceed 85% of the statutory minimum wage per hour (for volunteer neighbourhood helpers).

1. Promotion:

• They have received recognition as an offer of support in everyday life.
• They mainly work with volunteers.

There is no entitlement to the granting of funding. Rather, the granting authority decides on the basis of its dutiful discretion within the framework of the budget funds made available.

There are no fees.

None

b) Promotion of low-threshold services:

initial applications - by September 30 of the funding year;
Follow-up applications for the following year - until 30 September

Decisions regarding recognition according to § 45 a SGB XI: In this case, an objection to the decision of the authority is possible. After the objection, the appeal to the Social Court is given.

Decisions regarding the promotion of offers: In this case, the legal action before the administrative court is directly relevant against the decision of the authority.

The responsibility lies with the Lower Saxony State Office for Social Affairs, Youth and Family.

The written applications for recognition and, if necessary, for funding of recognised low-threshold care services should be sent to the competent authority together with the required documents.
