If you wish to be exempted from the obligation to wear a seatbelt and helmet, you must apply to the competent authority.
To protect road users, the legislator has stipulated that seat belts must be worn while driving and that suitable safety helmets must be worn when driving motorcycles.
In individual cases, however, it is possible to be exempted from this obligation on application. The resulting considerable safety risk is borne by the applicant.
You can be exempted from the obligation to wear a seat belt by way of exception,
- if it is not possible to wear a seat belt for health reasons.
- if your height is less than 150 cm.
You may be exempted from the obligation to wear a safety helmet by way of exception,
- if it is not possible to wear a safety helmet for health reasons.
The above-mentioned health requirements must be verified by a medical certificate. The medical certificate must expressly confirm that the applicant must be exempted from the obligation to wear a seatbelt or helmet on the basis of the medical findings. The diagnosis need not be stated on the certificate. be clear from the certificate.
The fee is currently between EUR 10.20 and EUR 767.00 in accordance with the German Road Traffic Fee Regulations (GebOSt).
The exemption is revocable andunless the medical certificate states a shorter duration, generally issued for a limited period of one year - unless the medical certificate attests to a permanent health condition that cannot be improved, in which case the exemption can be issued for an unlimited period.
The wearing of seat belts and safety helmets is compulsory in road traffic. However, an exemption from this obligation can be granted on application and with proof of a medical certificate.
