If your company starts a mining operation and wants to start prospecting, extracting and processing certain mineral resources, you must report this in advance to the relevant mining authority.

You must notify the competent authority of the commencement of a mining operation. If you do not submit the report in time, a fine of up to EUR 2,500 may be imposed.

The obligation to notify does not apply if you submit an operating plan instead.

If you want to mine mineral resources and you do not have to submit an operating plan for your project, you must attach a mining plan to your notification that contains all the essential details, in particular:

• the designation of the mineral resources you want to extract,
• a map of an appropriate scale with a precise indication of the field in which the mineral resources are to be extracted,
• Information on the type of operation, for example a drilling rig
• information on the intended work programme, the envisaged underground and surface facilities and the timetable;
  • Information on measures to reuse the surface during mining and on corresponding precautionary measures for the period after cessation of operation.

• Your project must not conflict with any overriding public interest.
• In addition, the project must be of low hazard and importance, so that the protection of employees and third parties and the reusability of the surface is ensured even without an operating plan obligation .

You can report the commencement of a mining operation online via the "BergPass" platform or directly to your local mining authority.

Submit a notification for the commencement of a mining operation online via the "BergPass" platform:

• Go to the online platform "BergPass" and register.
  • To register, you need a bundID and an identity card or residence permit with an active online ID function.
• Go to the advertisement form and fill it out completely and truthfully.
• Upload the required documents as a file and submit the advertisement.

Submit a notification for the commencement of a mining operation directly to the responsible mining authority:

• Get in touch with your local mining authority and coordinate the required documents.
• Submit the notification and all documents to your local mining authority.

Further procedural steps:

• The competent authority will examine your notification and the documents submitted. If documents are missing, the authority will contact you.

You will receive a notification confirming receipt of your advertisement. In addition, the message is sent electronically in advance to the respective mailbox (bundID or ELSTER company account) and information is displayed in BergPass.
