Are you planning longer night working hours for your employees? Then you can have these approved under certain conditions at the locally responsible office for occupational safety.
You need a permit from the local authority for occupational safety if you want to work longer at night in your company.
The authorisation of longer night work is provided for by law for:
- Shift operations
- Construction and assembly sites
- Seasonal and campaign operations, if the extension of working time is compensated by a reduction in working hours on other days
Certain exceptions are subject to maximum limits.
- The working time may not exceed 48 hours per week on average for 6 calendar months or 24 weeks.
You apply for authorisation in writing with the following steps:
- You submit a corresponding application to the Office for Occupational Safety and Health.
- You submit all the documents necessary for a decision on your application.
- The competent authority shall check the documents for completeness and, if necessary, request documents.
- If you meet all the requirements, you will receive a corresponding approval notice.
- If you do not meet the requirements, you will receive a rejection notice.
- You will receive a fee notice.
Depending on the examination effort (usually a few weeks after submission of the complete documents).
- Objection: The decision can be appealed to the locally competent authority for occupational safety and health within one month of notification.
- An unsuccessful opposition procedure is subject to a fee.
