In the case of neighbouring operating areas, the authority checks whether domino effects exist.
The competent authority is obliged to determine to the operators of operating areas in accordance with the Hazardous Incident Regulation for which operating areas or groups of operating areas may have an increased probability of incidents due to their geographical location, their distance from each other and the hazardous substances present in their facilities or these incidents may be more serious (domino effect). For the assessment, the Authority shall use, in particular:
- the information provided by the operator in the notification and in the safety report,
- the information provided by the operator following a request from the competent authority for additional information; and
- the information obtained by the competent authority through monitoring measures.
The information to be provided by the operator shall also include circumstances in the immediate vicinity of the operating area which may trigger an incident or aggravate its consequences, e.B. details of neighbouring operating areas, other sites not covered by the Incident Regulation and areas and developments from which an incident could emanate or where the probability of occurrence of an incident may increase or the effects of an incident and domino effects. Where the Authority has additional information, it shall make it available to the operator without delay where this is necessary for the cooperation of the operators.
Fees are charged for the assessment notice, which are based on the respective fee regulations of the federal states.
The procedure for detecting a domino effect shall be initiated by the competent authority. The assessment is based on
- the information provided by the operator in the notification and in the safety report,
- the information provided by the operator following a request from the competent authority for additional information; and
- the information obtained by the competent authority through monitoring measures.
If the conditions for a domino effect are met, the competent authority shall issue a declaratory decision to the operators concerned.
