Each property is shown in a special place in the land register on its own land register page. Land is generally subject to an obligation to be recorded in the land register.
Certain properties are exempt from this obligation, e.g. properties belonging to the federal government, the federal states, municipalities, churches or public roads.
A property that is exempt from the obligation to register but is nevertheless entered in the land register can be removed from the land register, i.e. deregistered, at the request of the owner. This requires that there are no encumbrances on the property.
- Written application by the owner
- The (new) owner is exempt from the obligation to register in accordance with Section 3 (2) GBO. These are the federal government, the federal states, municipalities and other municipal associations, churches, monasteries and schools, owners of watercourses, public roads and land dedicated to a railroad company serving public transport.
- There are no entries affecting the owner's rights.
- The rights in Section II and Section III have been deleted.
The derecognition note of the land registry must be entered in the inventory of the land register. If all properties entered on a sheet are deregistered, the sheet must be closed.
