State ordinance on the recognition and promotion of offers for support in everyday life, on the promotion of model projects and volunteer initiatives as well as on the promotion of self-help in accordance with Sections 45a, 45c and 45d of the Eleventh Book of the Social Code of July 12, 2017 (GVBl. p. 157) with amendments by ordinance of October 2, 2020 (GVBl. p. 539).

Anyone wishing to offer low-threshold care services to people in need of care must first have them recognized. The application for recognition of services in accordance with Section 45a SGB XI is made individually in the federal state in which the service is provided.

Low-threshold care and respite services are services in which caregivers under professional guidance

  1. in accordance with § 45c Para. 3 SGB XI provide care for those entitled to it in groups or in the home, as well as relieving and advising family members and caregivers with similar needs,
  2. in accordance with § 45c Para. 3a SGB XI
    a) support the beneficiaries in the household - in particular with domestic care
    b) accompany the beneficiaries in coping with the general or care-related demands of everyday life
    c) support the beneficiaries in the independent organization of individually required assistance services,
    d) relieve relatives or similarly close persons in their capacity as caregivers.

If you would like to offer a support service in everyday life, you will need recognition under federal state law.
Each federal state has a competent authority that is responsible for the recognition procedure.

The list of required documents differs from state to state

In Rhineland-Palatinate, the following must be submitted to the competent authority

  • signed and completed application for recognition (ADD form)
  • Concept describing the service and quality assurance of the offer
  • Various certificates, for example certificates of good conduct or proof of qualifications

Voraussetzungen

You must ask the responsible state authority about the relevant requirements.

In Rhineland-Palatinate, recognition as an offer for support in everyday life (offer with several helpers) essentially requires

  • the submission of a written concept to the competent authority for quality assurance of the offer
  • the target group and activity-specific qualification and regular further training of the professionals as well as the professional guidance, supervision, support and further training of the service providers who are not professionals themselves
  • the service providers, who are not individuals or professionals, must have completed a specified basic training course comprising at least 30 hours of instruction
  • The fees charged must be reasonable

Recognition as an offer of support in everyday life as an individual (who is not already a specialist) essentially requires

  • at least 160 hours of training based on the guidelines in accordance with Section 53b of the Eleventh Book of the German Social Code
  • Support from a specialist within the framework of a corresponding cooperation
  • The fees charged must be appropriate

Different regulations apply to domestic services that are offered on a limited scale (mini domestic services). Details can be found on the ADD website.

Kosten

Information on any costs incurred can be obtained from the contact person in the respective federal state.

No fees are charged in Rhineland-Palatinate.

The procedure depends on the respective federal state

In Rhineland-Palatinate, the Supervisory and Service Directorate (ADD) examines the application for recognition as an offer of support in everyday life.

If the documents show that the requirements for recognition are met, the authority issues the recognition by means of a notice.

In the case of domestic services that are offered on a limited scale (mini domestic services), recognition is granted through registration in a simplified procedure.
