If you already independently operate a craft subject to licensing and would like to exercise another craft subject to licensing or essential activities of such a craft, then you can apply for a right to exercise.
An entry with a craft subject to approval in the register of craftsmen is possible if you have a granted right to exercise. Two cases are distinguished:
- Right to exercise for other trades
For persons who already practice a craft subject to licensing and want to extend their commercial activity to another craft subject to licensing or essential activities of such a craft, there is the possibility to apply for a right to exercise.
In this respect, proof of the necessary knowledge and skills is required, taking into account previous professional experience and activities. It is irrelevant on what basis the existing entry in the register of craftsmen was made (e.g. master craftsman's certificate, old journeyman's regulation, exemption permit). The farmer concerned is entitled to apply.
- Right to exercise for journeymen and women with qualified professional experience
Anyone who has passed a journeyman's examination or a final examination in a recognised training occupation and has acquired relevant professional experience can become self-employed in many crafts subject to authorisation or exercise a management function. The professional qualification must have been acquired in the craft to be practised.
In the case of certain crafts, it is sufficient if the professional qualification was acquired in a craft related to it, as can be seen from the Regulation on related crafts.
In addition to a journeyman's or final examination, proof of relevant professional experience is also required, which must be acquired after the training. At least six years of professional experience is required, of which at least four years in a managerial position. A managerial position is to be assumed if the person concerned has been given independent decision-making powers in a company or a substantial part of the company, which must be substantiated by job references, job descriptions or in any other appropriate manner.
The granting of an exercise permit for journeymen or companions with qualified professional experience is not possible for chimney sweeps and health crafts (opticians, audiologists, orthopaedic technicians, orthopaedic shoemakers, dental technicians).
- Right to exercise for other business (application according to § 7a HwO)
- Copies of acquired formal professional qualifications (e.g. master craftsman's certificate).
- Right to exercise for journeymen and women with qualified professional experience (application according to § 7b HwO)
- Copies of formal professional qualifications acquired (journeyman's certificate, diploma).
- Certificates of at least six years of professional experience – application-related – of which at least four years in a managerial position.
- In addition to the application for the granting of an exercise right, an application for registration in the register of craftsmen must be submitted, if necessary.
- Right to exercise for other business (application according to § 7a HwO)
- On the basis of an existing entry in the register of craftsmen, a craft subject to authorisation is already being exercised.
- proof of the required knowledge and skills, taking into account previous professional experience and activities; Expert assessments, job references or further training can be considered as a means of proof.
- The standard of the certificate of competence is the masterly qualification for the craft subject to licensing, for which the right to exercise is sought.
- Right to exercise for journeymen and women with qualified professional experience (application according to § 7b HwO)
- Journeyman's examination in the craft to be practised subject to authorisation or in a craft subject to authorisation or a final examination in a recognised training occupation corresponding to the craft trade subject to authorisation to be practised.
- At least six years of activity in the craft to be operated subject to authorisation or in a craft subject to authorisation or in a trade subject to authorisation or in a profession corresponding to the craft to be practised subject to authorisation, of which a total of four years in a managerial position. The activity carried out must have included at least one essential activity of the craft subject to authorisation for which the right to exercise is applied for.
- A managerial position is to be assumed if a person has been given independent decision-making powers in a holding or in a substantial part of the business. Proof of this can be provided by job references, job descriptions or in any other way.
- The business, commercial and legal knowledge required for the independent practice of the craft is usually considered proven by the professional experience. If this is not the case, the necessary knowledge must be proven by participating in courses or in any other way.
The specific fee results from the list of fees of the Chamber of Crafts, which is available on the Chamber's website.
Before starting the activity, you must apply for the registration of the craft role on the basis of the exercise authorization granted.
