Has your building been completed and should it be used accordingly? Then you must report the building as completed and can use it after one week at the earliest.
A building may only be used once it has been properly completed and is safe to use.
In the case of structures requiring approval and structures for which the exemption procedure has been carried out in accordance with Section 67 of the Rhineland-Palatinate State Building Regulations (LBauO), the date of final completion must be notified to the lower building supervisory authority (notification of completion).
The building may be used at the earliest one week after the date stated in the notification of completion.
Upon application, the building supervisory authority should allow the building to be used earlier in whole or in part if there are no concerns about public safety or order.
When constructing or modifying combustion systems, the building owner must have the authorized district chimney sweep certify the safe usability of the flue gas systems and the connections of the fireplaces before commissioning.
If a notice of completion is required, the form issued by the local building supervisory authority must be used.
The fees are based on No. 5 of Annex 1 to the State Ordinance on Fees and Remuneration for Official Acts and Services under Building Regulations Law (Special List of Fees).
The notification of completion and, if applicable, the application for early commissioning must be submitted in writing to the locally responsible lower building supervisory authority.
The certificate of safe usability of the flue gas systems and the connections of the fireplaces must be applied for in good time from the authorized district chimney sweep.
The notification of completion must be received by the locally responsible lower building supervisory authority at least two weeks before the planned completion date. Use may commence at the earliest one week after the specified completion date.
Premature commencement of use can be punished as an administrative offense with a fine of up to €10,000 (Section 89 (4) No. 15 LBauO).
The lower building supervisory authority is responsible for accepting the notification of completion and, if applicable, for approving the premature commissioning of the building. This is the district administration, in independent and large towns belonging to the district, the municipal administration or the association of municipalities administration if it has been assigned building supervision tasks.
The authorized district chimney sweeps are responsible for certifying the fireplaces.
