If you want to set up commercial gaming machines with the possibility of winning, you need the permission of the competent authority.

For the installation and operation of gaming equipment that is

• are equipped with a technical device that influences the outcome of the game, and which
• offer the possibility of a win,

you need a permit.

With a permit to set up such gambling machines with the possibility of winning, you can set up gambling machines throughout Germany. Each installation site must be individually permitted by the competent authority. Money gaming machines may only be set up if you have all the necessary permits.

• Certificate in tax matters (tax clearance certificate) from the tax office (to be applied for at the tax office of the place of residence)
  
• Identity card or passport with a current registration certificate
  (in case of representation with written power of attorney: identity card or passport of the authorized person, as well as a copy of the identity card of the grantor of the power of attorney)
  
• Certificate of good conduct in the document type OG (for submission to an authority)
  (to be applied for at the local registration office responsible for your place of residence)

• Information from the insolvency court as to whether proceedings have been opened
  (to be applied for at the local court of your place of residence)

• Information from the central business register in document type 9
  

• Completed application form

• Certificate of instruction in the protection of gamblers and minors:
  With a certificate from the Chamber of Industry and Commerce, you must prove that you have been instructed in the knowledge necessary for practicing the trade.

• Social concept of a publicly recognized institution:
  The social concept describes the measures taken to prevent the socially harmful effects of gambling.

• Excerpt from the commercial register or, in the case of legal entities still in the process of being established, the articles of incorporation and shareholders' agreement.

• You have the required reliability. This is checked by the authority when the application is made.
• The design of the gaming equipment is approved by the Physikalisch-Technische Bundesanstalt.
• The place of installation complies with the implementation regulations of the trade regulations.

The competent authority may impose conditions at any time, both on you and on the trader in whose business a gaming device is installed.

Depending on the case, the fee is 250.00 to 1,000.00 euros.

• First, you must obtain all the necessary documents and submit them to the authority with the written application.
• The authority checks your reliability under trade law.
• If all requirements are met, you will receive the permit with a fee notice.

• If you want to set up gaming machines with the possibility of winning on a commercial basis, you need a permit in accordance with § 33c Gewerbeordnung (Trade, Commerce and Industry Regulation Act).
• Certain requirements must be met.
• Fees are incurred.
• Responsible: the responsible trade authority.
