You would like to operate a nationwide system for the disposal of packaging waste? Then you must apply for an official permit for this.

If you want to operate a nationwide system for the disposal of sales packaging, you need an official determination.
The highest state authority responsible for waste management or the authority designated by it will determine upon your application that the system has been established on a nationwide basis.

The determination may subsequently be subject to ancillary provisions that are necessary to ensure that the conditions that existed when the determination was issued are also met on a permanent basis during the operation of the system. The determination shall be publicly announced and shall be effective from the date of public announcement.

After the determination has been made, you must ensure the regular collection of used, empty sales packaging from private final consumers or in their vicinity free of charge throughout the specified catchment area. You must recycle the packaging collected in your collection system in accordance with the statutory requirements. Several systems may cooperate in setting up and operating their systems.

If you submit an informal application for system determination or a preliminary inquiry in this regard to the supreme waste authority, you will be informed in writing or in a personal meeting about the requirements necessary for a successful application.

In accordance with Part A, Section 1, No. 13.1 of the Thuringian Administrative Cost Regulations for the Portfolio of the Ministry of Agriculture, Nature Conservation and the Environment (ThürVwKostOMLNU): 2,500 to 25,000 euros.

There are no deadlines to be observed.

The supreme state authority responsible for waste management or the authority designated by it may require, at the time of determination or subsequently, that the system operator provide adequate, insolvency-proof security in the event that it or its agents fail to fulfill the obligations under this Ordinance in whole or in part and the public waste management authorities or the competent authorities may demand reimbursement of costs due to substitute performance.

Since 2008, there have been nine nationwide systems for the disposal of sales packaging. All of them operate their systems nationwide. This also makes more sense than a system that is only nationwide. For a nationwide system determination, you need the determination in all 16 federal states. This cannot be done by a "central" determination. For a nationwide system activity, you must therefore submit the applications in accordance with § 6 Para. 5 VerpackV to all 16 supreme waste authorities in order to obtain the system determinations.
