Companies that perform installation, maintenance, repair or decommissioning for third parties on equipment containing fluorinated greenhouse gases (F-gases) require company certification in accordance with Section 6 (1) of the Chemicals Climate Protection Ordinance (ChemKlimaschutzV).
Since July 4, 2009, companies that perform installation, maintenance, repair or decommissioning for third parties on facilities containing fluorinated greenhouse gases (F-gases) have required company certification in accordance with Section 6 (1) of the Chemicals Climate Protection Ordinance (ChemKlimaschutzV). Facilities using F-gases covered by this regulation are stationary
- refrigeration systems,
- air conditioning systems,
- heat pumps,
- fire protection equipment.
The certification requirements are to be fulfilled regardless of the filling quantity of F-gases
A questionnaire must be completed in the application form as proof of the above-mentioned requirements. A copy of the relevant certificates of competence of the employees in accordance with Section 5 (1) ChemKlimaschutzV must be enclosed with the application.
For activities on stationary fire protection equipment, a list of equipment must also be submitted.
Exception: Within 3 years after a regular certification, only the proof of the change of name (e.g. extract from the commercial register or business re-registration) is required for a renewed certification due to a change of name (name change, relocation, etc.) of the company.
The following requirements for company certification must be met in accordance with Article 6 (1) of the Implementing Regulation (EU) 2015/2067 of November 17, 2015 (in the field of refrigeration and air conditioning) or Article 8 (1) of Regulation (EU) 304/2008 of April 2, 2008 (in the field of fixed fire protection equipment):
- The company must have a sufficient number of employees to cover the expected volume of activities. sufficient number of persons who are holders of a personal certificate of competence in accordance with Article 5 Paragraph 1 ChemKlimaschutzV with regard to the activities requiring certification.
- The company must provide evidence that all necessary tools and procedures are accessible to the persons performing activities requiring certification
The administrative fees for a company registration according to § 6 ChemKlimaschutzV amount to 250 - 1,250 Euro depending on the size of the company, the number of personnel certificates and the effort required to check the documents and prepare the certificate.
If a new certification is applied for within three years after a regular certification due to a change of the company's name, a reduced fee of 125,- Euro applies.
In Thuringia, a certificate of certification of a company is issued upon application by Department 73 at the Thuringian State Office for the Environment, Mining and Nature Conservation.
If several federal states are involved in the certification of companies, it is recommended that the application be submitted at the company's headquarters, but branches in the Free State of Thuringia can also submit their application here.
Since July 4, 2009, persons who install, check for leaks, maintain, repair, decommission or recover fluorinated greenhouse gases require a certificate of competence in accordance with Section 5 (1) ChemKlimaschutzV.
The certificate of competence relates to the following activities:
- Activities on stationary refrigeration systems, air conditioning systems and heat pumps,
- Activities on stationary fire protection systems,
- Activities on refrigerated vehicles and trailers,
- Activities on switchgear,
- For activities on motor vehicle air conditioning systems, a training certificate is required.
The certificate of competence is issued by the Chamber of Crafts, the Chamber of Industry and Commerce or the Guild of Craftsmen after a corresponding examination or recognition of a certificate of completion of a training course that meets the requirements specified in the respective implementing regulation of the EU Commission.
Corresponding examinations can also be taken at (commercial) training institutions that are officially recognized.
- Testing and certification bodies in accordance with the Chemicals Climate Protection Ordinance Recognition.
- Companies that perform installation, maintenance, repair, or decommissioning for third parties on equipment containing fluorinated greenhouse gases (F-gases) are required to obtain company certification.
- Requirements for corporate certification are:
- The company must have a workforce sufficient to cover the anticipated volume of activities sufficient number of persons who are holders of a personal certificate of competence in accordance with Article 5 (1) ChemKlimaschutzV with regard to the activities subject to certification.
- The company must provide evidence that all necessary tools and procedures are accessible to the persons carrying out activities subject to certification.
- Certain documents must be submitted.
- Fees are incurred.
