If you are an engineer and would like to obtain a building design authorization, you can, if you meet the requirements, be entered in the list of list of engineers authorized to submit building documents.

As a corporation under public law, the Thuringia Chamber of Engineers must perform essential tasks to safeguard the professional interests of engineers and at the same time, in the public interest, maintain the lists and directories required by law, including the list of engineers authorized to submit building documents (Section 21 (3) No. 2 ThürAIKG).

Entry in the list of engineers authorized to submit building documents at the Thuringia Chamber of Engineers entitles the holder to compulsory membership as a member of the Thuringia Chamber of Engineers and also entitles the holder to sign building documents for the construction and alteration of buildings that are not exempt from procedures as draft versions and to submit them to building authorities.

According to the legal requirements of Section 64 (2) and (3) ThürAIKG, entry in the list of engineers authorized to submit building documents and the associated acquisition of the authorization to submit building documents requires a professionally qualifying educational qualification as well as practical experience in a field of civil engineering, including building construction.

Only those graduates of universities and technical colleges who have been taught essential subjects such as structural engineering, building mechanics, building materials science, building physics, structural engineering, hydraulic engineering, etc. as part of their studies in civil engineering are to be regarded as civil engineers in this sense.

The entry in the list of engineers authorized to submit building designs also confirms that the registered person possesses the professional qualifications required by law as well as the necessary professional experience in the design planning of buildings and, as a chamber member, is subject to the professional law of engineers, including its control by the Thuringia Chamber of Engineers.

As a rule, the following documents are required:

• fully completed application documents including Annex 2 (technical sheet for the application for entry in the list of engineers authorized to submit building documents)
• Copy of identity card/passport
• Curriculum vitae in tabular form
• Proof of training including a copy of the training certificate (diploma, Bachelor's/Master's certificate, etc.)
• Proof of at least 2 years of practical experience in the field of design planning of buildings (project list, references from engineering firm/construction company, etc.) after completion of training
• Registration certificate regarding main residence or proof of a professional establishment or the exercise of the predominant professional activity in Thuringia
• Official certificate of good conduct
• Proof of sufficient professional liability insurance

Should this be necessary, the Thuringia Chamber of Engineers may request the submission of further evidence, complete project documents for the design planning of buildings and the submission of certified copies of evidence.

The list of engineers authorized to submit building proposals at the Thuringian Chamber of Engineers is entered upon application, § 64 Para. 3 ThürBO:

1. anyone who has a professionally qualified university degree in the field of
   structural or civil engineering and

1. has been practically active in the field of design planning of buildings for at least two years
   buildings for at least two years.

The applicant must provide the documents and evidence required for the assessment of the above requirements.

In addition, the applicant must also provide proof of adequate professional liability insurance in accordance with Section 33 ThürAIKG.

Persons who are established in another member state of the European Union or equivalent states as authorized building project presenters are also authorized to present building projects without being entered in the list of engineers authorized to present building projects of the Thuringian Chamber of Engineers if they

• have a comparable authorization and
• had to fulfill comparable requirements as described above.

They must notify the Thuringian Chamber of Engineers in advance of their first activity as an authorized building designer in the Free State of Thuringia and submit corresponding proof of the legality of the exercise of the building design authorization in the country of origin as well as the fulfillment of the requirements as an authorized building designer (§ 64 para. 4 ThürBO).

Once the application has been submitted and proof has been provided that the aforementioned requirements have been met, entry is made in a corresponding register at the Thuringian Chamber of Engineers, unless notification has already been submitted or a certificate issued in another country of the Federal Republic of Germany.

The application fee for processing the application for membership and entry in the list of engineers authorized to submit building documents is generally € 450.00.

The legal basis for charging fees is the cost regulations of the Thuringia Chamber of Engineers dated 19.10.2023.

Once the application has been submitted, the Thuringia Chamber of Engineers will confirm receipt of the application, including the evidence submitted, to the applicant within one month and, if applicable, inform the applicant which evidence is still missing.

A decision on the application will be made within three months of receipt of the complete supporting documents at the latest, although this period may be extended by a further month.

As a result of the examination to be carried out by the registration committee of the Thuringia Chamber of Engineers as to whether the legal requirements have been met, the applicant will be sent a corresponding decision. The decision made therein constitutes an administrative act.

The documents submitted by the applicant with the application, with the exception of project documents for the design planning of buildings, remain with the Thuringia Chamber of Engineers and are archived there.

Statutory processing deadlines according to ThürAIKG

The chamber will confirm receipt of the application to the applicant within one month. The applicant will be informed of any additional documents required.

A decision on the complete application will be made within the shortest possible time, but within three months at the latest. In individual cases, the deadline may be extended once by up to one month if this is justified due to the particularities of the matter.

There are no deadlines to be observed by the applicant. Rather, the decisive factor for submitting an application is the applicant's own interest in obtaining the right of presentation.

Proof of at least two years' experience in the field of project planning for buildings must be provided.
Membership of the pension fund is established upon entry in the corresponding list.

An appeal against a decision of the Thuringia Chamber of Engineers may be lodged with the administrative court responsible for the applicant's place of residence within one month of receipt of the decision, in writing or for the record of the clerk of the administrative court.

There are no preliminary proceedings or appeal proceedings.
