If a deceased person has been inherited by several persons, the law does not allocate different items to each individual. All heirs participate in the deceased's estate with their share. The estate is jointly owned by the heirs. No co-heir can dispose of an object alone. The cooperation of all heirs is always required. All heirs together form the so-called community of heirs.
If the estate is to be divided, the heirs must agree on the division. If no agreement can be reached, the notary mediates between the co-heirs upon request. In this process, the objects of the estate or their proceeds are distributed among the co-heirs in such a way that each receives as much as corresponds to his or her share in the community of heirs.
If the other co-heirs do not cooperate, the distribution can also be enforced by an action for the division of the estate.
In the event of disputes between heirs, an application for mediation may be filed. The notary is responsible.
