Before submitting a building application, it is possible, at the request of the client, to clarify individual questions relating to a subsequent building permit procedure in a binding and final manner by means of a preliminary building inquiry.

A preliminary building inquiry is useful, for example, if it is unclear whether a property can be built on at all in accordance with the applicable building planning law or whether deviations from individual building code requirements can be permitted.

A preliminary building inquiry can save financial expenditure, as not all of the documents required for a building permit are necessary.

In addition, the building owner receives planning certainty at an early stage regarding the buildability of a property or the permissibility of deviations.

In addition to the application form, all documents required for the assessment of the question posed must be submitted. As a rule, these are

• Site plan or extract from the cadastral map,
• description of the project and
• the construction drawings required to assess the question posed

The fees can amount to between €75 and €5000, taking into account the respective inspection costs.

The preliminary decision is valid for three years and binds the planning permission authority to the statements made in the preliminary decision for this period.

An extension of the preliminary decision is possible upon application.

To clarify simple individual questions, it is not necessary for building documents to be prepared by planners authorized to submit building documents.

Depending on the issues to be assessed, the municipality or the neighbors must be involved.

The preliminary decision is an anticipated part of the building permit that is not subject to re-examination in the building permit procedure.
