If you wish to marry abroad, it may be that there is a legal standard in the intended country of marriage which requires the presentation of such a certificate.
The issuance of a certificate of eligibility for marriage abroad is also possible in Germany for stateless persons, persons entitled to asylum, recognised refugees and persons whose nationality cannot be determined.
The certificate is issued by the registry office in whose area of jurisdiction the applicant has his or her residence or habitual abode.
The certificate of marriageability is valid for a period of six months.
- The prerequisites, type and format of the evidence to be provided and the examination of the prerequisites for marriage are governed by German law, as is the case with a German citizen.
- Evidence must be provided by means of public documents:
- The civil status.
- The place of residence, habitual abode.
- The nationality.
- As well as, if applicable, the last marriages and/or civil partnerships and their dissolutions.
- If the person wishing to marry abroad has one of the following personal statuses:
- Stateless
- entitled to asylum
- recognised refugee
- or persons whose nationality cannot be ascertained
- as well as having their habitual residence in the country.
- Costs may be incurred for the issue of a certificate of marriageability. Please contact your registry office.
- An application for a certificate of marriageability is submitted to the competent registry office.
- If the examination shows that there is no impediment to the intended marriage under German law, and if the required information on the person of both spouses has been provided, the registry office will issue the requested certificate of marriageability.
- The registry office can issue a certificate of marriageability for stateless persons, persons entitled to asylum, recognised refugees and persons whose nationality cannot be established, with habitual residence in Germany.
- The registry office responsible is the one in whose area of jurisdiction the applicant has his or her residence or habitual abode.
