Your tasks as a publicly appointed expert include the assessment of services and activities in the skilled trades and their value. You should provide factually sound assessments of skilled trade work, products and services and the prices charged for them.

As an appraiser, you are the figurehead for the performance of the skilled crafts sector. Your professional skills and knowledge as well as your integrity are not only important for your personal reputation, but also for the reputation of the skilled crafts sector as a whole.

As an applicant, you are therefore only entitled to public appointment and swearing-in if your special expertise, independence and impartiality have been verified and it is therefore beyond doubt that you meet the requirements set out in the respective expert regulations of the chambers of skilled crafts - in particular personal suitability and proof of special expertise.

These selection criteria include that you as an applicant

  • Generally meet the requirements for entry in the Register of Craftsmen, i.e. as a rule, have passed the master craftsman's examination in a craft requiring a license or have acquired another qualification, for example as an engineer; the same applies to crafts not requiring a license and trades similar to crafts,
  • are particularly knowledgeable and qualified to provide expert opinions,
  • have the equipment required to carry out the work of an expert witness,
  • live in orderly financial circumstances and
  • offer a guarantee of impartiality and independence in the provision of expert opinions as well as reliable compliance with the obligations of a publicly appointed and sworn expert.

If you prepare expert opinions as a publicly appointed and sworn expert, you must always rule out the possibility of the expert opinion being used for your own commercial or other professional purposes. You must always be aware that particularly high demands are placed on your honesty and objectivity.

Erforderliche Unterlagen

  • Proof of sufficient professional experience
  • Proof of personal suitability, in particular reliability and physical and mental capacity in accordance with the requirements of the field applied for. Among other things, the following must be submitted: police clearance certificate, extract from the central trade register, clearance certificates from the tax office and health insurance companies
  • Proof of the necessary practical experience and the ability to prepare expert opinions
  • Availability of the necessary facilities (basic equipment)
  • Orderly financial circumstances
  • In the case of salaried employment, the applicant must in any case submit a declaration of exemption from the employer for the expert activity.

Voraussetzungen

You are entitled to be publicly appointed and sworn in if the examination of your special expertise, independence and impartiality was successful and the other requirements are met.

These selection criteria include that you

  • are generally entered in the register of craftsmen, i.e. you have usually passed the master craftsman's examination or have acquired another qualification, for example as an engineer,
  • are particularly knowledgeable and qualified to provide expert opinions,
  • have the equipment required to carry out the work of an expert,
  • live in good financial circumstances and
  • guarantee impartiality and independence in the provision of expert opinions and
  • guarantee compliance with the obligations of a publicly appointed and sworn expert.

Proof of your special expertise (specialist knowledge and skills that are significantly above average) is provided by the written documents you enclose and in accordance with a procedure drawn up by the chambers of crafts and trades which, in addition to the preparation of a trial report and a written test, also provides for an oral expert discussion before a competent committee.

Kosten

The amount of the fee is based on the scale of fees in conjunction with the schedule of fees of the relevant Chamber of Crafts.

The costs for the procedure vary depending on the trade, usually starting at 2,500 euros.

Verfahrensablauf

If you have submitted the application for public appointment and swearing-in as an expert, the completeness of the application documents will be checked by the relevant Chamber of Skilled Crafts.

The competent Chamber of Skilled Crafts will then usually hear the competent trade association and/or the competent guild.

The Chamber of Skilled Crafts may require you to attend training courses at your own expense to prove your special expertise and oblige you to undergo an examination by a panel of experts at your own expense. In addition to the preparation of a test report and a written test, the examination may also include an oral expert discussion.

Finally, depending on the decision of the committees involved, you will be sworn in as an expert. You will receive the certificate of appointment, expert certificate and round stamp.

Bearbeitungsdauer

The responsible office will process your application as quickly as possible. If an examination date has been set, processing can only take place after this has been completed.
