The construction, operation and significant modification of genetic engineering facilities of safety levels 1 to 4 and other genetic engineering work of safety levels 2 to 4 require notification/registration confirmation or approval by the competent genetic engineering authority.

Genetic engineering facilities of safety levels 1 to 4 are facilities in which genetic engineering work is carried out in a closed system in order to limit the contact of the organisms used with humans and the environment and to ensure a level of safety appropriate to the hazard potential.

Genetic engineering work may only be carried out in genetic engineering facilities.

As the operator of a genetic engineering facility, you must notify, register or obtain approval from the competent authority for the construction and operation of the facility as well as for any further genetic engineering work, depending on the safety level. The competent authority will confirm receipt of the application without delay.

The approval procedure requires a written application. You must enclose all documents required for notification, registration or approval.

An administrative fee must be paid in accordance with the state ordinance on administrative fees. The obligation to pay fees also includes the rejection of requested official acts. Detailed information on this can be obtained from the responsible office.

Notification/registration/approval of the construction and operation of, or significant changes to, genetic engineering facilities S1-S4:

As the operator, you must notify or register the planned first-time genetic engineering work and the construction or operation or significant changes to a genetic engineering facility S1 - S4. Once the notification has been received by the authority, you can only start work directly at safety level 1. Subsequent requests may arise in which you may be asked to submit further documents and information. You will then receive a confirmation of receipt with these possible statuses: Application in order, with additional request, with reasons for failure. You will then have the opportunity for a hearing with a draft decision and finally the decision, including a fee notice if applicable.

As operator, you must notify the competent authority, register it or have it approved before setting up and operating the genetic engineering facility.

If the Thuringian State Office for the Environment, Mining and Nature Conservation does not grant the permit, you will be sent a rejection notice. In this case, you can lodge an appeal. How to do this is described in your decision (information on legal remedies).
