You are an employer and certain protective measures of the Ordinance on Industrial Safety and Health can only be implemented at great expense to you and are not proportionate? Then it is possible to apply for an exemption from these.

The following serves to grant exceptions to the protective measures described in the Industrial Safety Regulation

• in the case of hazards due to energies,
• to further protective measures,
• to the specifications for maintenance and modification of work equipment,
• measures to be taken in the event of special operating conditions,
• malfunctions and accidents,
• as well as on the special regulations for elevator systems

Application with the following information

• Reason for requesting the exception, description of the disproportionate hardship,
• Risk assessment related to the affected workplaces, activities and processes,
• number of employees likely to be affected,
• technical and organizational measures to be taken to ensure safety and avoid hazards,
• Expert opinion on the equivalence of the planned technical and organizational measures.

The prerequisite is that the application of these provisions would lead to disproportionate hardship for the employer in the individual case.

1. Submission of the application, the expert opinion and the risk assessment online
2. Follow-up action and review by the authority
3. This is followed by the notice of exemption or rejection of the application

Appeal will be communicated in the notice.
