You have to pay a wastewater levy for discharging wastewater into a surface water/groundwater and have invested in the new construction/expansion of wastewater facilities/feeding systems. You apply to the assessment authority for offsetting of these expenses.

A wastewater levy is charged for the discharge of wastewater (sewage and polluted precipitation water) into surface water or groundwater. This can be offset under certain conditions.

You discharge wastewater into a surface water or into groundwater and have, for example, made investments for:

• the construction/expansion of wastewater treatment plants (§ 10 para. 3 AbwAG) or

• the construction/expansion of facilities that feed wastewater from existing discharges to a wastewater treatment facility (§ 10 Para. 4 AbwAG)

e.g. construction of a separate sewer system to connect small discharges or a suburban sewer system to a wastewater treatment plant; construction of a storm sewer through which the precipitation water is fed to a rainwater clarifier, construction of a RÜB to eliminate a stormwater overflow into the water body.

This results in a reduction of the levy amount to be paid or in the reimbursement of a levy amount already paid.

The expenses incurred can be offset against the total levy owed for this facility in the three years prior to the facility's commissioning. The calculation of the offsetting period is carried out to the day. It is not possible to offset the increased part of the wastewater charge due to the exceeding of a monitoring value. You must apply to the responsible office for offsetting of the expenses incurred using the appropriate forms. The responsible office will be happy to assist you with any questions that may arise and will request further documents or proof of the offsetting measure if necessary.

You discharge wastewater into a surface water or into groundwater and have e.g. investments for:

• the construction/expansion of wastewater treatment plants/rainwater discharge facilities (§ 10 para. 3 AbwAG) e.g. wastewater treatment plants, separator plants or
• the construction/expansion of facilities that feed the wastewater of existing discharges to a wastewater treatment plant (§ 10 Para. 4 AbwAG)

e.g. construction of a separate sewer system to connect small discharges or a suburban sewer system to a wastewater treatment plant; construction of a rainwater sewer through which the precipitation water is fed to a rainwater clarifier.

Depending on the facilities for which expenses are claimed, the corresponding applications must be submitted:

• Application for offsetting according to § 10 Para. 3 AbwAG.

(details of the wastewater treatment plant, date of commissioning, details of pollutant reduction, proof of expenditure)

• Application for offsetting in accordance with § 10 Para. 4 AbwAG

(information on eliminated discharges due to connection to a wastewater treatment plant, date of connection, information on construction work, proof of expenses)

An application for offsetting presupposes that the party liable to pay the levy has to pay or has already paid a wastewater levy in the offsetting period and has incurred expenses.

There are no fees/expenses for processing the application.

The processing time depends on the quality and volume of the submitted application and documentation.

A refund or a reduction of the payable wastewater levy by offsetting is only possible within three years after the year of assessment. In order to fully utilize the scope of the offsettable wastewater levy, the application must be submitted within the three-year period

An appeal against the wastewater levy notice may be lodged within one month of notification. The objection has no suspensive effect.

• A wastewater charge is levied for the discharge of wastewater (sewage and polluted precipitation water) into a surface water body or into groundwater. This can be offset under certain conditions.

In Thuringia, the Thuringian State Office for the Environment, Mining and Nature Conservation (TLUBN), Ref. 51 "Wastewater, Wastewater Levy" is responsible.
