Requesting approval for a seat belt and hard hat exemption.

The respective competent road traffic authorities can issue exemptions according to § 46 StVO within the framework of the General Administrative Regulation for the StVO.
This legal basis makes it possible to grant exemptions from a number of regulations and prohibitions, e.g. the obligation to wear seat belts and safety helmets in accordance with Section 46 (1) No. 5b of the StVO.

Application for exemption from the obligation to wear a safety helmet

1.) Submission of a medical certificate

2.) Application with justification or the following information:

• Extent of driving,
• regularly used route,
• type and strength of the motorcycle used,
• whether the applicant is dependent on the use of the motorcycle

• whether other means of transport, e.g. public transport, can be used.

In the case of an exemption, the public interests pursued by the prohibition - from which the exemption is to be granted - must be weighed against the particular interests of the applicant, taking into account the principle of proportionality. The high interest in protection against serious and most serious consequences of accidents, which is served by the helmet and seat belt requirement, must be weighed against a correspondingly high interest in driving without a seat belt or safety helmet for health reasons.

The costs for the procedure are calculated in accordance with the Fee Regulations for Road Traffic Measures (GebOSt) and are variable depending on the scope of services provided by the authority.

The application must be submitted in writing to the responsible road traffic authority. The authority will decide on the possibility of granting an exemption from the obligation to wear seat belts and safety helmets in the exercise of due discretion.
