Would you like to determine the course of a parcel boundary on site, check boundary markers or re-mark boundary points? To do this, it is necessary to apply to the relevant authority for a boundary re-establishment, possibly with marking, or a boundary notification.
As part of a boundary restoration procedure, the position of a boundary point recorded in the real estate cadastre can be transferred to the local area in accordance with the cadastral record, restored and, if necessary, subsequently re-marked on application. Boundary restoration is a sovereign real estate survey, the result of which is transferred to the real estate cadastre.
A parcel boundary can also be indicated locally by a boundary notice in accordance with the cadastral record and marked locally with day marks. The boundary notice does not constitute a sovereign real estate survey and the result is not included in the real estate cadastre record. The costs for a boundary indication are lower than for a boundary restoration.
Further information can be found on the website of the Thuringian State Office for Land Management and Geoinformation (TLBG):
The following is required to process the application:
- > Identification of the applicant (personal document)
- Details of the parcel of land concerned (district, parcel, parcel number, postal address if applicable)
- In the event that the applicant is not also the party liable for the costs, an informal confirmation of assumption of the costs
- > Consent of the owner if he is not the applicant himself
The costs (fees) for carrying out a boundary restoration / boundary notification are based on the schedule of costs for the Thuringian administrative cost regulations for official surveying (ThürVwKostOVerm) - subject matter: fees for preparation, for surveying services and for acceptance. The amount of the fee depends, among other things, on the size of the surveyed area, the standard land value per m², the number of boundary points to be set, the boundary lengths to be surveyed and the number of markings that may be required.
The procedure is divided into the following main steps:
1. application
2. examination of the documents (including authorization to apply) by the surveying office
3. preparation of the surveying service by the surveying office
4. execution of the local surveying service by the surveying office:
a) Verification of boundary markers or restoration of boundary points
b) if necessary, marking of boundary points (on request)
c) Hearing of the parties involved in the procedure (e.g. owners of the affected parcels) and recording of the boundary record with sketch, if necessary recording of a boundary determination contract
6. notification of the administrative act to the parties involved by written notification or disclosure by the surveying office
7. submission of the survey results to the Thuringian State Office for Land Management and Geoinformation (TLBG) for transfer to the real estate cadastre
8. cost decision of the surveying office for the preparation and surveying services
9. transfer of the surveying results to the real estate cadastre after expiry of appeal periods by the TLBG
10. issuance of the cost decision by the TLBG for the transfer of the boundary restoration to the real estate cadastre
The processing time depends on the scope of the benefit applied for. More detailed information can be obtained from the relevant authorities.
Yes, since an administrative act is issued, a legal remedy is possible within a certain period of time.
On application, the position of a boundary point recorded in the real estate cadastre can be transferred to the local area in accordance with the cadastral certificate as part of a boundary restoration procedure, restored and, if necessary, subsequently re-marked on application.
Land surveys for e.g. private applicants, municipal bodies and federal administration bodies are carried out exclusively by publicly appointed surveyors (ÖbVI) licensed for the territory of the Free State of Thuringia, who are also available to provide advice. Further information can also be obtained from the contact persons in the respective cadastral areas of the TLBG (see also details under "Responsible body") This is also where land surveys are carried out for the direct state administration and the state forestry office.
An overview of public surveyors can be found below under "Additional contact directories for download" (-> PDF "Directory of publicly appointed surveyors in Thuringia"):
