Do you want to transport passengers in a cab on a commercial basis? You can apply for the necessary permit at the competent transport authority.

You need a permit for the commercial transportation of passengers by cab.

You can apply for a permit at your local traffic authority in the city or district where you live.

The so-called occasional traffic includes, among other things, the traffic with cabs.

Entrepreneurs have to meet the following requirements for the permit:

The financial capacity of the business and the professional suitability of the entrepreneur must be guaranteed.

The applicants, or persons familiar with the management of the business, must be reliable.

In addition, the company's registered office must be in Germany.

The permit is issued for a limited period of time (depending on the means of transport).

• formal application (surname, first name of the applicant; place of residence and operation; for natural persons: Date of birth, place of birth; number of vehicles, type of vehicle, capacity of vehicles to be used)
• Service certificates or examination certificates (on professional qualification) of the applicant or the person appointed to run the business
• Equity certificate / additional certificate (form according to § 2 paragraph 2 number 2 / § 2 paragraph 3 of the Berufszugangsverordnung für den Straßenpersonenverkehr PBZugV), not older than 12 months
• Clearance certificate from the tax office, the municipality, the social insurance institutions and the employers' liability insurance association, not older than 3 months (from the company, the legal representative and the person appointed to manage the business / transport management)
• Certificate of good conduct for submission to the authorities in accordance with Section 30 (5) of the German Federal Law on Civil and Professional Conduct (BZRG)
• Extract from the Central Trade Register in accordance with Section 150 (5) GewO (in the case of companies)
• Extract from the driver suitability register (FAER)

General documents

• Vehicle list, if applicable rental vehicles with rental agreement or leasing list
• Proof of liability insurance for cabs including risk indicator (WKZ)
• Business registration
• In the case of partnerships, the list of shareholders, the shareholders' agreement or other proof of contractual authorization
• certified extract from the commercial register

• The safety and efficiency of the business is guaranteed.
• There are no facts indicating the unreliability of the applicant as an entrepreneur or the person appointed to manage the business.
• The applicant as an entrepreneur or the person appointed to manage the business is professionally suitable.
• The applicant and the entrepreneurs appointed by him or her to provide transport services must have their registered office or place of business within the meaning of commercial law in Germany.

New applicants and existing entrepreneurs shall be given appropriate consideration. Within the two groups, consideration is given according to the chronological order in which applications are submitted.

Irrespective of the order in which the application is submitted, the following shall be given lower priority

• who does not intend to operate the cab business as his or her main occupation,
• has not operated his or her cab business as a principal occupation, or has sold or leased all or part of his or her cab business within the last 8 years,
• has not properly fulfilled his or her duty to operate the business.

Only one permit may be issued to an applicant at a time, provided that no more permits can be issued than there are applicants.

New applicants shall receive their permits for 2 years. During this period, the rights and obligations arising from the permit may not be transferred.

In the case of legal entities under public law, the requirements are deemed to have been met.

The amount of the fees depends on:

• the number of vehicles and
• the term of the permit.

Proceed as follows to obtain a permit for the commercial transportation of passengers by cab:

• Submit a corresponding application to the transport authority responsible for you in the respective independent city or district and enclose all necessary documents with the application.
• The authority will process your application and conduct the necessary hearing procedures.
• You will receive a decision on the granting or re-granting of a cab license, including the handover of the license documents.

The processing time may vary between the responsible transport authorities. The processing time may depend, among other things, on whether all documents relevant to the decision have been submitted or whether additional documents are required.

Deadlines do not start to run until an application that is ready for a decision has been submitted. If your application is complete, a decision will be made on it within 3 months. The deadline can be extended by 3 months if necessary. The general objection period under administrative procedure law is one month.
