The competent authority must monitor compliance with the regulations when operating facilities for the application of non-ionizing radiation to humans outside of medicine, also called commercial application (e.g. solariums).
As part of this monitoring, the competent authority may also order that a facility be inspected by a body that can perform necessary measurements. If you wish to offer testing of solar systems and comparable systems for the application of non-ionizing radiation to humans, this requires notification of your facility as a testing body.
- detailed list of the measuring equipment and measuring instruments intended for the inspection,
- Proof of scientific, technical training for the inspectors to be appointed,
- Proof of training in accordance with § 5 of the UV Protection Ordinance (UVSV),
- Proof of a successfully completed measuring course,
- proof of instruction in the use of measuring equipment,
- current police clearance certificate for each of the appointed inspectors.
Proofs must be submitted to the competent authority in the original or as a copy. A certified copy as well as a certified German translation of foreign language documents may be required. The competent authority shall acknowledge receipt of the documents submitted by the applicant within one month and, if necessary, indicate which documents still need to be submitted. Insofar as the contents of an applicant's previous training or activity differ significantly from the contents that are considered to be the required specialist knowledge, an aptitude test or an adaptation course may be imposed on the applicant.
Proof of the required expertise, independence, reliability and technical equipment must be provided.
The notification of the inspection body is subject to a fee. The costs are calculated according to the time spent.
The notification as an inspection body is made upon written or electronic application to the competent body. The notification is valid for the entire federal territory.
The decision on the application is made by the competent body of the country in which the applicant has his place of business. The application shall be granted if the applicant has the required expertise, independence, reliability and technical equipment.
It may be subject to revocation, a time limit, conditions, requirements and the reservation of conditions.
A decision on the application must be made within a period of 3 months. The period begins with the receipt of the complete documents. It may be reasonably extended once if this is justified by the difficulty of the matter. Reasons must be given for any extension of the deadline. You will be notified of it in good time before the original deadline expires. If no decision is taken on the application within the 3-month period or the extended period, approval is deemed to have been granted.
You can appeal against the decision on your application or against a decision that was not made in due time in accordance with the Administrative Court Code (action before the Administrative Court).
