In order for an association to assume guardianship, it requires permission from the state youth welfare office.

• Proof of registration of the association
• Articles of association
• Number and training of employees
• Number of residential places
• Proof of appropriate insurance in accordance with § 54 Para. 2 No. 1 SGB VIII
• Proof or planning of the preparation and further training of employees and the recruitment of individual guardians

A registered association with legal capacity is authorized to assume guardianship if it

• has a sufficient number of suitable employees and supervises, trains and adequately insures them against any damage they may cause to others in the course of their work,
• makes a systematic effort to recruit individual guardians and individual carers and introduces them to their tasks, provides them with further training and advice,
• facilitates an exchange of experience between employees.

An application is required for recognition of the association. As the state youth welfare office, the state youth welfare office checks that the requirements are met and issues the permit.

The permit may be limited in time or subject to further conditions. The permit is valid for the respective federal state in which the association is based.
The permit can be limited to the area of a state youth welfare office.
