In accordance with Section 70 of the Road Traffic Licensing Regulations (StVZO), Section 76 of the Vehicle Registration Ordinance (FZV) and the State Ordinance on the Determination of Competent Authorities in the Field of Road Traffic (Road Traffic Jurisdiction State Ordinance - StVZustLVO M-V), the Mecklenburg-Vorpommern State Office for Road Construction and Transport can approve exemptions from the provisions of these ordinances before these vehicles are allowed to participate in public road traffic.

The exemptions can be granted for a period of validity of up to twelve years if there are deviations from the regulations in accordance with Sections 32, 32d and 34 StVZO. In other cases, unlimited exemptions are possible.

The exemptions granted must be documented by the vehicle driver in the form of a certificate, must be carried when driving and must be handed over to the responsible persons for inspection on request.

Erforderliche Unterlagen

    § 70 StVZO of an officially recognized expert for motor vehicle traffic or an authorized signatory of a technical service recognized in accordance with § 30 of the EC Vehicle Approval Regulation (EG-FGV) for testing complete vehicles of the respective vehicle class
    • To extend an existing exemption permit: Copy of the old §70 StVZO exemption permit, an expert opinion may have to be submitted subsequently
    • To supplement or amend an existing exemption permit: Supplementary report not older than 18 months
    • To transfer an existing exemption permit: Existing exemption permit with the corresponding expert opinion and the registration certificates
  3. Registration certificate or operating license of the vehicle or vehicle combination or, in the case of a new application, an expert opinion on obtaining the operating license (not older than 18 months) in accordance with § 21 StVZO (operating license, if applicable registration certificate part 1 and part 2 including the supplements)
  4. Previous exemption permit, if applicable
  5. Insurance certificate, if applicable

Voraussetzungen

The prerequisite for an exemption permit in accordance with Section 70 StVZO or the Vehicle Registration Ordinance (FZV) is the submission of the required documents (informal application, expert opinion from the technical inspection body for motor vehicle traffic or the technical service and a copy of the vehicle documents) to the body responsible for the permit. As a general rule, exemptions may only be approved if all reasonable possibilities for complying with the provisions of the StVZO and the FZV have been fully exhausted. If, on the other hand, a deviation from the regulations, in particular with regard to dimensions, cornering, axle loads or total masses, is only necessary for certain vehicle types or purposes away from public traffic areas (e.g. use on construction sites), an exemption permit is generally not required. Confirmation of technical suitability in the vehicle documents is sufficient for this purpose, provided that the other values are documented and complied with in accordance with the regulations.

Kosten

Notices of costsare based on the scale of fees for road traffic measures (GebOSt) in conjunction with the scale of fees for the scale of fees for road traffic measures (GebTSt). In accordance with No. 255 GebTSt, a framework fee of €10.20 to €511.00 is set for each decision on an exemption from a provision of the StVZO per exemption and per vehicle/owner; if there are several vehicles of the same design when the application is submitted, a reduced fee may be set. The exact amount of the fee depends on the processing effort and economic advantage for the applicant in each individual case; the determination is at the discretion of the authority.

The amount of the fee also depends on the period of validity. When submitting your application, you must therefore state the desired period of validity. The amount of the expenses is based on
§ 2 GebOSt.

According to § 2 Para. 2 of the scale of fees for road traffic measures, the applicant bears the costs of additional copies, duplicates and extracts that are issued at his special request. Number 31000 of the Schedule of Costs under the Court and Notary Costs Act applies to the calculation of typing expenses.

Verfahrensablauf

The required application documents are

  1. an informal application, which must contain the following information, such as full details of the applicant, the name of the vehicle or vehicle combination, the name and reasons why the exemption is requested and the intended period and area of validity.
  2. Expert opinion on the deviations from the construction and operating regulations

    Before you can apply for an exemption permit for a vehicle or vehicle combination, you need an expert opinion from an officially recognized expert for motor vehicle traffic or an authorized signatory of a technical service recognized in accordance with § 30 of the EC Vehicle Approval Regulation (EG-FGV) for the inspection of complete vehicles of the respective vehicle class.

    The expert opinion must state the necessary exemptions from the StVZO, the suitability of the vehicle or vehicle combination and the requirements and conditions deemed necessary in the interests of road safety. The expert must describe the exemptions in detail and justify their necessity.
  3. Complete copy of the vehicle documents (operating license, if applicable, registration certificate part 1 including supplements)

    Once your application has been received, the granting of the exemption is at the discretion of the approval authority. In Mecklenburg-Vorpommern, this is the Mecklenburg-Vorpommern State Office for Road Construction and Transport, which is only responsible for applicants with their main place of residence or company headquarters in the state of Mecklenburg-Vorpommern. The exemption can be granted for a limited period and for a limited territory.

    If the requested exemptions can be granted, you as the applicant will receive a written notification of the exemption by post for a fee. Once the exemption has been granted, the vehicle or vehicle combination must be registered by the local registration authority, if this has not already been done.

    In Mecklenburg-Vorpommern, the district administrators or the mayors of the independent towns and large towns belonging to the district are responsible for exemptions to the design and affixing of license plates in accordance with Section 12 of the Vehicle Registration Ordinance (FZV).

An exemption permit in accordance with Section 70 StVZO does not include permission in accordance with Section 29 (3) of the Road Traffic Regulations (StVO) and therefore does not include permission for journeys that deviate from the provisions of the StVO. § Section 29 (3) StVO requires a "permit for the movement of vehicles and trains whose dimensions (including cornering), axle loads or total masses actually exceed the legally permissible limits or whose design does not allow the driver a sufficient field of vision". This permit must always be issued by the authorities responsible for the StVO (after checking the route) before the journeys, which in the cases concerned can also be included as a condition in every exemption permit.

Hinweise

The local jurisdiction is generally based on your main place of residence or the registered office of your company. Exemption permits are always issued to the holder and must contain a reservation of revocation. The transfer of the exemption permit to a new holder is only possible with the consent of the approval authority responsible for the new holder.

If the Mecklenburg-Vorpommern State Office for Road Construction and Traffic has decided on the exemption in accordance with Section 70 StVZO, you can lodge an objection against the granting, non-granting or insufficient granting of the exemption. The objection must be addressed to the Mecklenburg-Vorpommern State Office for Road Construction and Traffic. If the Mecklenburg-Vorpommern State Office for Road Construction and Traffic does not uphold the objection and issues an objection notice, you can take legal action against the objection notice before the administrative court.
