People are entitled to this benefit if they
- have their habitual residence in the Federal Republic of Germany and
- have reached the standard retirement age as defined by the statutory pension insurance (65 years plus x months) or
- have reached the age of 18, are fully incapacitated for work within the meaning of Section 43 (2) of the statutory pension insurance, irrespective of the respective labor market situation, and for whom it is unlikely that the full reduction in earning capacity can be remedied.
This social assistance benefit is only granted on application.
The need includes, among other things
- the standard rate applicable to the beneficiary according to the standard needs levels,
- the requirements for accommodation and heating:
- for beneficiaries outside institutions, the reasonable expenses for accommodation and heating (rent and ancillary rental costs),
- for beneficiaries in institutions, the average reasonable actual expenses for the warm rent of a single-person household in the area of the responsible social welfare provider
- any additional requirements (e.g. additional requirements of 17% of the applicable standard rate in the case of a severely disabled person's pass with the G mark),
- any requirements for education and participation,
- possibly supplementary loans in accordance with § 37 Paragraph 1 SGB XII,
- possibly a loan for income due at the end of the month in accordance with § 37a SGB XII (for people who cannot fully cover their necessary living expenses from their own resources in the month in which they receive their pension for the first time until the pension is actually received).
There are special regulations for the requirements for accommodation and heating for persons entitled to benefits in multi-person households (living together with at least one parent, an adult sibling or an adult child), provided they are not contractually obliged to pay accommodation costs
or
in the case of shared accommodation
or
in other accommodation (e.g. rooms in hotels, boarding houses, vacation apartments and caravans on campsites through to emergency accommodation.
If the requirements are met, basic security benefits in old age and in the event of reduced earning capacity are granted from the date of application, whereby the approval period begins on the first of the month in which the application is submitted. No (retroactive) benefits are granted for periods prior to the application.
With regard to a provisional decision on the provision of cash benefits to the applicant, the special provisions of Sections 44a and 44b SGB XII apply.
The special feature of this social benefit is that children or parents are only required to pay maintenance if they have a total annual income of over 100,000 euros.
It should also be noted that benefit recipients who stay abroad for more than four weeks without interruption during a temporary stay abroad generally do not receive any benefits after the end of the fourth week until their proven return home.
Anyone who has deliberately or through gross negligence caused their own neediness within the last 10 years prior to submitting an application will not receive basic old-age and reduced earning capacity benefits.
Among other things:
- Identity card,
- Proof of permanent reduction in earning capacity (determination by the pension insurance provider),
- Proof of income - including that of the spouse or partner or partner in a marriage-like relationship (e.g. pension statements, child benefit, maintenance payments, if applicable, partner's earnings, unemployment benefit or other social benefits),
- Proof of existing assets (e.g. savings, life insurance),
- Proof of expenses (e.g. rental agreement, rent receipts, heating bills, documents on insurance premiums),
- if applicable, divorce decree, maintenance order,
- Disability certificate (if available),
- Residence permit (for foreigners),
- Proof of health and long-term care insurance,
- if applicable, caregiver's certificate or certificate of appointment (if applied for by a third party).
The scope of the documents required depends on the specifics of the individual case and is determined by the responsible social welfare agency.
- An application for basic security benefits has been submitted (application requirement).
- There must be a need. It must not be possible to ensure one's own necessary means of subsistence from one's own resources, in particular from one's own income and assets.
- The income of persons obliged to pay maintenance must not exceed the annual amount of 100,000 euros.
- The neediness was not caused intentionally or through gross negligence within the last 10 years prior to the application.
Basic income support in old age and in the event of reduced earning capacity is granted on application. It can be applied for in person or by sending an informal letter to the responsible social welfare provider. An application form will be handed out or sent from there. The completed application form can either be handed in personally or sent by post.
Basic security benefits in old age and in the event of reduced earning capacity are generally granted for a period of 12 months. If a provisional decision is made on entitlement to benefits, the approval period should be reduced to a maximum of six months.
