If it transpires after the certificate of inheritance has been issued that the requirements were either not met from the outset or have subsequently ceased to apply, the certificate of inheritance must be withdrawn ex officio. This may be the case, for example, if the information on the amount of the inheritance was entered incorrectly.
If the certificate of inheritance is withdrawn or declared invalid, the fee is half of the so-called full fee. This is based on the value of the estate: EUR 15.00 - 400.00
If there is any doubt about the accuracy of the certificate of inheritance, the probate court will make the necessary investigations ex officio. You can also informally request the withdrawal of a certificate of inheritance if you are adversely affected by an incorrect certificate of inheritance. If the certificate of inheritance is found to be incorrect, the probate court will withdraw it. If the certificate of inheritance cannot be withdrawn immediately, it will be declared invalid. This is announced publicly. The declaration of invalidity becomes effective after one month.
