Every trader who offers goods or services to end consumers on a commercial basis or who advertises by stating prices is obliged to state the price including VAT and all price components that may be incurred, i.e. the final price.
If the goods or services are offered by telephone, internet or other means of distance communication, the delivery and shipping costs must also be stated.
In the case of services, price lists must be visibly displayed in the business premises. In restaurants, price lists must be displayed on the tables or handed out to guests before they order.
The Price Indication Ordinance also requires that in trade with end consumers, not only the final price but also the converted price per unit of quantity (basic price) must be indicated in the immediate vicinity of the final price if goods are offered by weight, volume, length or area. The unit of measure is 1 kilogram, 1 liter, 1 cubic meter, 1 meter or 1 square meter.
The Price Indication Ordinance does not apply to business-to-business (B2B) relationships.
Violations of the Price Indication Ordinance are punished in administrative offense proceedings. The regulatory authorities are responsible.
An incorrect or omitted price indication can also result in a warning from a competitor or a warning association.
