Upon application, auctioneers with special expertise, with the exception of legal entities, shall be publicly appointed by the competent authority; this applies accordingly to employees of auctioneers. The appointment may be made for certain types of auctions, provided there is a need for auction services for these. The persons publicly appointed pursuant to sentence 1 shall be sworn to perform their duties conscientiously, free from instructions and impartially.

Possession of a professional and personal aptitude

The costs are based on the administrative fee schedule of the state or on the fee statutes of the authorities responsible under state law.

The processing time is influenced by any expert opinions that may have to be obtained on the application.

The public appointment as a particularly competent auctioneer is limited in time and may be extended.
