If you are in possession of a residence permit and are subject to a residence regulation and would like to move, this is possible under certain conditions.

If, as a foreign national, you are subject to a residence obligation for a specific location, you can, under certain conditions, have this residence obligation lifted or changed if you wish to move to another federal state. To do this, you must submit a corresponding application to the relevant immigration authority.

The required documents always refer to the respective reason for the relocation request. The requirements must be proven. The requirements can also be fulfilled by a family member of the applicant. In addition to the documents listed below, the competent immigration authority may request further documents from you in individual cases.

Person entitled to asylum, refugee or recognized person in need of subsidiary protection

• Gainful employment
  • Employment contract or job offer for employment subject to social insurance contributions for at least 15 hours, which generates at least an income equivalent to the average monthly requirement for an individual in accordance with Book II of the German Social Code (Sozialgesetzbuch)
• Study or training place
  • Training contract or certificate of study
• Place of residence of the person in a marriage/life partnership/minor child with you

• Employment subject to social security contributions (at least 15 hours per week and a net income of at least EUR 820.00 (as of April 2022)) or an income that secures their livelihood
• Apprenticeship or place at university
• The persons in a marriage with you, your registered civil partnership or the minor child with whom you are related and live or have lived together as a family lives in a different place of residence.
• Avoidance of hardship (e.g. humanitarian reasons)

Other foreign person who is subject to a residence regulation

• An income that secures your livelihood
• Training or study place
• The person you are married to, your registered civil partner or the minor child lives in another place of residence.

• If you would like to apply to change or cancel a residence restriction on your residence permit, you must first submit an application to your local immigration authority.
• Please discuss in advance which documents you need to enclose with your application.
• The immigration authority will check your application and usually ask the immigration authority of your new place of residence for approval.
• Once the examination has been completed, you will receive a corresponding decision.

The duration of processing depends on the foreigners authority.

Fictitious approval

If the immigration authority of the new place of residence does not respond to the request from the immigration authority of the current place of residence within four weeks, approval is automatically granted and the applicant may move.

• A move is only possible once your previous immigration authority has given its approval. Therefore, please avoid moving before you have received this approval.
