A traveling camp is a sales event that a trader operates outside his commercial establishment from a fixed point of sale. This does not apply if the event takes place as part of a market, exhibition or trade fair established in accordance with Section 69 GewO.
The organizer of the touring camp must notify the authority responsible for the location of the touring camp if the touring camp is to be advertised publicly. The organizer must also inform the competent authority whether the arrival and departure of the participants to and from the location of the hiking camp is to be carried out by commercial transport provided by the organizer or by persons in cooperation with the organizer.
This means that the obligation to notify applies in particular to so-called coffee trips.
If the obligation to notify exists, the following information must be submitted to the authorities:
- the location, date and time of the hiking camp,
- the name of the organizer and the person for whose account the goods or services are being sold, including the address at which these persons are established, and in the case of legal entities, the legal form and the authorized representatives,
- information that enables quick contact and direct communication with the organizer, including a telephone number and an e-mail address,
- the commercial register, register of associations or register of cooperatives in which the organizer is entered and the corresponding register number,
- the wording and form of the intended public announcement and
- the name of a representative of the organizer of the hiking camp named in the announcement who is authorized in writing to manage the camp on behalf of the organizer.
If the touring camp is to be held abroad, the notification must be submitted to the authority responsible for the place where the organizer is based.
Insofar as it is subject to the notification requirement, the hiking camp may only be managed on site by the organizer named in the notification or a representative authorized by him in writing.
- Identity card or passport with a registration certificate of the persons involved (notifying party, authorized representative)
- in the case of legal entities entered in the commercial, cooperative or association register of a local court, a current extract from the register
- Travel trade license of the organizer
- business registration of the person on whose account the goods or services are sold, if different from the organizer
- the intended public announcement
The organizer of a hiking camp must be in possession of a travel trade license.
The representative of the organizer authorized in writing must be in possession of a duplicate or a certified copy of the travel trade card of the organizer.
For non-EU foreigners: In principle, a residence permit that allows the exercise of self-employed activity is required.
In Mecklenburg-Vorpommern, the acceptance of a notification of a hiking camp is free of charge. Only the prohibition of the hiking camp is subject to a fee of between 32 and 424 euros in accordance with tariff item 127 of the M-V Commercial Costs Ordinance of 01.09.2023.
The independent towns and cities, as well as the local authorities and independent municipalities, are responsible for accepting the notification of the notifiable hiking camp.
The organizer of a hiking camp must notify the authority responsible for the location of the hiking camp at least four weeks before the start of the camp.
If the notification is not submitted on time, truthfully or in full, the competent authority may prohibit the organization of the hiking camp.
Anyone who violates the obligation to notify is committing an administrative offense pursuant to Section 145 (3) No. 1 GewO, which is punishable by a fine of up to EUR 10,000.
It is prohibited to sell or broker certain financial services, medical products and food supplements during a hiking camp.
