A referendum shall not be held on the internal organization of the administration, on the legal relationships of persons working full-time or in an honorary capacity for the municipality or the district, on decisions within the framework of municipal or district budgeting, auditing and taxation and, within this framework, also on decisions on fees and municipal operations, on decisions pursuant to Section 36 of the Building Code, on the preparation, amendment and cancellation of urban land-use plans and on other matters which are the subject of a referendum, amendment and cancellation of urban land use plans as well as on other matters to be decided within the framework of a planning approval procedure or a formal administrative procedure with public participation or a waste disposal law, immission control law, water law or comparable approval procedure, on participation in municipal cooperation, on statutes regulating a connection or use obligation, as well as on applications pursuing an unlawful objective.

No fees or expenses shall be charged by the municipality or county for holding a referendum.

The municipal council or the district council shall pass a resolution on the holding of a citizens' referendum and shall decide whether the citizens' referendum is to be held as a vote in voting rooms, at a residents' meeting or as a purely postal vote. The municipality shall publicly announce the question to be decided, the manner in which the citizens' referendum is to be held, the voting period and the requirements for eligibility to vote and for casting a vote no earlier than six weeks and no later than two weeks before the start of the citizens' referendum. Instead of publicly announcing the voting districts and voting rooms, the municipality may notify those entitled to vote of this in writing.

The opinion expressed by the municipal or county bodies on the question posed shall be presented to the citizens in sufficient time before the referendum so that they can include the relevant arguments in their decision.

The wording of the respective citizens' or representatives' petition shall be used for the question of the citizens' referendum. With the consent of the representative persons, the municipal council or the district council may change the wording of the citizens' petition in such a way that the comprehensibility of the question is increased or a previously inadmissible question becomes admissible.

The vote shall be general, free, equal, direct and secret. The municipality shall conduct the referendum in such a way as to ensure compliance with these voting principles and to exclude any distortion of the vote.

After the closing of the voting rooms, the voting committees shall determine the voting results in the voting district in public session, on which minutes shall be taken, and shall notify the voting committee thereof. The latter shall establish the voting result for the entire municipality or the entire district in public session and shall prepare minutes thereof. The result of the referendum shall be made public by the municipality or the district without delay.
