The residents' motion is a means for residents to exert influence. By means of a residents' motion, residents can request that the municipal council or the district council deal with certain matters.
A residents' motion enables the residents of a municipality or a district to have certain matters dealt with by the municipal council or the district council.
Residents' motions may only deal with important matters within the municipality's or district's own sphere of action.
The residents' motion must be submitted in writing to the municipal council or the district council and must contain a statement of reasons.
For the signatures required in the context of a residents' application, application lists or individual applications are to be used, which are to be signed personally by each applicant. In addition to the signature, the surname, first name, date of birth, address and date of signature shall be legibly entered. Each new signature page of the application lists or each individual application must be preceded by the wording of the application.
The residents' application must name up to three persons who are authorized to represent the signatories. The names of the persons authorized to represent the signatories shall precede each new signature page of the application lists or each individual application.
The residents' motion is addressed to the municipal council or the district council. The municipal council or the district council decides whether the residents' motion is admissible in terms of its content and formal requirements. This decision is announced to the representatives. Before an admissible residents' application is dealt with by the municipal council or the county council, the representative persons shall be heard at the meeting of the municipal council or the county council.
Admissible motions shall be dealt with by the municipal council or the district council without delay.
The application can be submitted at any time, unless a permissible application with the same content has already been dealt with within the last year. The one-year period for a further residents' application with the same content begins on the day of receipt of the admissibility decision by the municipality or the district by the representative persons.
