With the partial building permit, you can start construction work on the change of use of building sections before the building permit is issued. To do this, you submit an application for a partial building permit to the responsible lower building supervisory authority.
If you have applied for a change of use permit and would like to start changing the use of part of the building structure before the permit is granted, you will need a partial building permit for these changes of use. To do this, you submit an application for a partial building permit to the responsible lower building supervisory authority.
In the application, you specify the parts of the building structure for which you want to start the change of use before the permit is issued.
The partial building permit for the change of use of a facility is subject to a fee.

You receive a partial building permit for a change of use:
- if the underlying building application is complete with regard to the changes of use units applied for partial building permit,
- the described building project is in compliance with the public law regulations to be examined in the building inspection procedure.
- Fee range: EUR 60.00 to EUR 1,680
- The fee for the individual partial building permit, insofar as it exceeds EUR 180.00, can be credited against the fee for the building permit, taking into account a lower level of review effort in the building permit procedure.
- The cost calculation takes into account the expected costs of the construction work and the effort required for checking the parts of the building application relevant for the partial building permit.
You apply for a partial building permit for the change of use of a facility in the online procedure or in text form.
Make the application and state in it to which building application your application for partial building permission relates and which construction measures it covers. Attach the required construction documents. Submit the application documents to the relevant lower building supervisory authority.
The lower building supervisory authority will review your application and involve the municipality and those bodies whose participation or hearing is required for the decision on the partial building permit or without whose opinion the approvability of the application cannot be assessed. You will then receive the decision on your application.
The partial building permit is subject to a fee. You will receive a fee notice. If necessary, the lower building supervisory authority will ask you to make an advance fee payment after you have submitted your application.
- In the regular partial construction permit procedure, there is no application period and no approval period.
- The partial construction permit expires if the execution of the modification project has not been started within three years after it has been granted or if the execution has been interrupted for more than one year. Within the period of validity, the application may be extended by up to 1 year at a time.
