If a district electoral committee rejects a district nomination in whole or in part, any representative of the rejected nomination, the district returning officer and the state returning officer may lodge a complaint by 6 p.m. on the 45th day before the election.
The responsible election committee (state election committee for the state list or district election committee for the district election proposal) decides on the approval of the election proposals in a public meeting on the 52nd day before the election at the latest. The representatives of the nominations must be invited to the meeting and given the opportunity to comment before the election committee makes its decision.
The responsible election committee examines the nominations and the documents submitted with them. However, facts which are reliably known to the election committee or which are obvious may be taken into account by it.
The election committee rejects election proposals that are received late or do not comply with other legal provisions.
After the end of the 73rd day before the election, only deficiencies in valid election proposals can be rectified. An election proposal is only valid if it
- bears the signatures required pursuant to Section 16 (7) and Section 55 (5) LKWG M-V and
- clearly identifies the election proposal holder and the person of the nominated candidates and
- contains the copy of the minutes pursuant to section 16 paragraph 5 LKWG M-V and the consent pursuant to section 16 paragraph 3 LKWG M-V as well as any affidavits required pursuant to section 16 paragraph 4 LKWG M-V.
A nomination may be amended up to the expiry of the submission deadline (75th day before the election, 4 p.m.). An election proposal may be withdrawn as long as no decision has been made on its approval. After the decision on the approval of an election proposal, any amendment is excluded. Any amendment or withdrawal requires concurring declarations by the representatives. Nominations for the Landtag election may be amended or withdrawn up to the time of approval. These declarations must be submitted in writing to the competent electoral management body (Land electoral management body or district electoral management body) and cannot be revoked. A nomination that has been signed by at least 100 eligible voters in accordance with Section 55 (5) LKWG M-V may also be withdrawn by the majority of the signatories by means of a joint written declaration.
Any amendment or withdrawal requires the concurring written declarations of the representatives. If no second person of trust has been designated in the case of individual applications, only the declaration of the individual applicant is required.
Admission:
The responsible election committee (state election committee or district election committee) decides on the approval of the election proposals (state lists or district election proposals) in a public meeting on the 52nd day before the election at the latest.
Amendment:
An election proposal can be amended up to the deadline for submission (75th day before the election, 4 p.m.).
Withdrawal:
An election proposal can be withdrawn as long as a decision has not yet been made on its approval.
