The notification must contain the name and the abbreviated designation under which the party intends to participate in the election and must be signed personally and in manuscript by the authorized representatives responsible for the electoral area in accordance with its statutes. The written statutes and the written program of the state organization of the party as well as proof of the democratic election of the state executive committee shall be attached to the advertisement; proof of party status pursuant to Section 2 (1), first sentence, of the Political Parties Act shall be attached to it.
Parties which, on the day of the call for nominations, have not been represented in the Mecklenburg-Western Pomerania Landtag or in the German Bundestag since its last election on the basis of their own nominations without interruption by at least one member elected on their behalf in Mecklenburg-Western Pomerania may only submit nominations if they have notified the Land electoral administration in writing of their participation in the election by 6 p.m. on the 108th day before the election and their party status has been established by the Land electoral committee.
Submission
- The party declares in writing that it will participate in the election and submits the required documents in full.
- The state election administration shall note the date of receipt on each notification of participation and shall immediately check whether it complies with the requirements of the law (preliminary examination).
Elimination of defects
- If the state election management finds defects, it shall immediately notify the party executive committee and request the party executive committee to remedy remediable defects in a timely manner.
- After the decision of the State Election Committee on the determination of party status, any rectification of defects shall be excluded.
Examination and admission
- The State Election Committee shall summon the parties that have notified their participation in the election to the meeting at which its decision on their recognition as a party for the election shall be taken. It shall submit the notifications of participation to the State Election Committee and report on the results of the preliminary examination.
- Before the decision is taken, the parties concerned shall be given the opportunity to comment.
- The State Election Committee shall make a binding determination for all election bodies,
- which parties have parliamentary representation
- for which parties the Federal Election Committee has determined party status in the last election to the German Bundestag,
- which associations which have indicated their participation are to be recognized as parties for the election.
Announcement
- Following the determination, the State Election Committee shall announce the decision of the State Election Committee at the meeting and briefly state the reasons. The decision shall be made public.
The notification of participation must be received by the state election administration by 6 p.m. on the 108th day before the election.
The Land electoral committee shall, no later than on the 94th day before the election, determine in a binding manner for all electoral bodies
- which parties, on the day of the call for nominations, have been represented in the Landtag of Mecklenburg-Western Pomerania or in the German Bundestag without interruption since its last election on the basis of their own nominations, with at least one representative elected for them in Mecklenburg-Western Pomerania,
- which associations that have indicated their participation are to be recognized as parties for the election.
