Reisegewerbe: Ausnahmegenehmigung beantragen

If you want to carry out an activity that is not permitted in the travel trade, you can apply for an exemption permit under certain conditions.

The following activities, among others, are prohibited in the traveling trade:

• Distribution of
  • poisons and goods containing poisons
    (Exception: plant protection products, pesticides and wood preservatives for which a test certificate with test mark has been issued in accordance with building regulations)
  • Hernia bandages, medical bandages, medical support devices and bandages, orthopaedic foot supports, spectacles and eyeglasses
    (exception: protective goggles and prefabricated reading glasses)
  • electromedical devices including electronic hearing aids
    • (exception: devices with direct heat exposure)
    • securities, lottery tickets, subscription and share certificates for securities and lottery tickets
      (Exception: sale of lottery tickets as part of approved lotteries for charitable purposes on public paths, streets or squares or other public places)
    • Publications that are distributed with the promise of prizes or winnings
  • Offering and the purchase of
    • Precious metals (gold, silver, platinum and platinum alloys) and precious metal alloys in any form as well as goods with precious metal overlays
      (Exception: silver jewelry up to a sales price of 40.00 euros and goods with silver plating)
    • Precious stones, gemstones and synthetic stones as well as pearls
  • Offering alcoholic beverages
    (Exception: beer and wine in tightly sealed containers, alcoholic beverages made from self-produced products of viticulture, agriculture or fruit and horticulture, the purchase of alcohol for the production of liqueurs and spirits from fruit, plants and other agricultural raw materials where the raw materials are not fermented by the customer, and alcoholic beverages that are served for consumption on the premises as part of and for the duration of an event from a fixed establishment)
  • Concluding and brokering repurchase transactions (Section 34 para. 4 GewO) and brokering loan transactions for the borrower in return for payment
  • Offering medicinal products for sale and soliciting orders for medicinal products (Section 51 of the Medicinal Products Act)
    (Exceptions: Finished medicinal products released for sale outside pharmacies, which are plants or parts of plants commonly known for their effects or pressed juices from fresh plants or parts of plants designated by their customary German names, provided they have not been prepared with any solvent other than water, or medicinal waters and their salts in their natural mixing ratio or their imitations.
    Insofar as the trader visits other persons in the course of their business, unless the medicinal products in question are offered for sale for use on animals in agricultural and forestry operations, in commercial animal husbandry and in vegetable, fruit, horticultural and viticultural operations, beekeeping and fishing, or orders for medicinal products whose dispensing is reserved for pharmacies are sought from these operations. This also applies to traveling salesmen and other persons acting on behalf of and in the name of a trader).
  • Distribution and transfer of firearms, ammunition, cutting or thrusting weapons (Section 35 para. 3 sentence 1 no. 1 WaffG)
    (Exception: soliciting other persons in the course of their business)
  • Distribution and transfer of explosive substances, insofar as a traveling trade license would be required or the requirements of Section 55a para. 1 no. 1 or 3 of the Trade Regulation Act are met (Section 22 para. 4 sentence 1 no. 1 Explosives Act)
    (Exception: distribution and supply of category F1 pyrotechnic articles)

Exceptions are also possible by ordinance of the federal or state government. However, there are currently no such ordinances.

You must apply for exceptions to the bans on a case-by-case basis to the competent authority.

• Travel trade license (if required, §§ 55a, 55b GewO)

The exact amount of the fee depends on the administrative costs. The framework fee in M-V is EUR 15.00 - 149.00.

You can apply for exceptions to the prohibitions on itinerant trades on a case-by-case basis to the trade authority of the district or independent city in which you wish to operate.

• Appeal against the rejection of the exceptional approval (detailed information on how to file an appeal can be found in the notification).

• Some activities are prohibited in the itinerant trade; the competent authority may allow exceptions in individual cases. Exceptions are also possible by ordinance of the federal or state government. However, there are currently no such ordinances.
• Exceptions to prohibitions must be applied for from the competent authority on a case-by-case basis.
• The exemption permit is applied for at the trade authority of the district or independent city in which you wish to operate.
• The exemption permit is limited to the area of responsibility of the issuing authority and is always limited in time.
• The exemption permit can be limited to certain types of events.
