The Animal Welfare Act clearly formulates the responsibility of humans for animals. This means that no one is permitted to inflict pain, suffering or harm on an animal without good reason.
No one may cause pain, suffering or harm to an animal without reasonable cause.
Violations in this context are prosecuted as an administrative offense or a criminal offense and are punishable by fines, penalties or imprisonment.
If violations are discovered in this context, they must be reported to the competent authority (veterinary office or police).
Responsibility depends on the severity of the violation. In principle, any infringement can be reported to the competent veterinary office, which will initiate further action. In the case of an administrative offense, the veterinary office acts on its own authority; in the case of a criminal offense, the case is forwarded to the police and public prosecutor's office. In this case, the veterinary office takes on the role of investigator.
The more comprehensively and precisely the events and observations are described in the report, the easier the subsequent work of the investigating authorities will be. In order to be able to follow up on an animal welfare report, the following points should therefore be included wherever possible:
- Your name and full address and contact details (telephone number, e-mail address) (remain anonymous if you wish)
- Name and address of the animal owner (if known to you)
- Name and address of any witnesses and contact details (telephone number, e-mail address)
- Describe the details factually and accurately.
- Do not omit any important facts - but please do not invent anything either.
- Animal species and number of animals affected
- Note important details such as: Date, time, exact location.
If necessary, take photos and/or videos with the date and time.
Anonymous reports will also be investigated.
- You file a complaint with the competent authority.
- The facts of the case will be investigated (if necessary by means of an on-site inspection) and, if necessary, administrative or criminal proceedings will be initiated.
If you have complaints about noise from animals (e.g. loud barking) or biting and dangerous animals, please contact your local public order office.
