Natural mineral water may only be marketed commercially if it has previously undergone an official procedure for recognition and approval of use.
Natural mineral water is groundwater that originates from underground water sources that are protected from contamination and is extracted from one or more springs. It is of pristine purity and characterized by its content of minerals, trace elements or other constituents. Its composition, temperature and other essential characteristics remain constant within the framework of natural fluctuations. It is untreated or may only be subjected to a few, precisely prescribed treatment processes.
Natural mineral water may only be marketed commercially if it is officially recognized. Official recognition is granted upon application.
Official recognition in Germany is equivalent to official recognition by a member state of the European Union or a state party to the Agreement on the European Economic Area.
Information on the documents can be found in the General Administrative Regulation on the Recognition and Authorization of Use of Natural Mineral Water (AVV Mineralwasser, sections 3.3 - 3.5).
This includes in particular
- the information listed in Annex 1 of the AVV Mineralwasser, including the expert assessment
- if several extraction points are used, the information listed in Annex 1, No. 3.4.3, 4 and 6 of the AVV Mineralwasser for each extraction point
- Proof of the constancy of the mineralization of the water.
Further documents may be required.
Official recognition can only be granted if the requirements according to § 2 of the Mineral and Table Water Ordinance are met and this has been verified under geological and hydrological, physical, physico-chemical and chemical, microbiological and hygienic aspects and, in the case of waters with less than 1,000 milligrams of dissolved minerals or less than 250 milligrams of free carbon dioxide in one liter, also under nutritional or other aspects using scientifically recognized methods.
The information listed in Annex 1 of the AVV Mineralwasser must be complete and have been assessed by an expert. In the case of several tapping points, the documents specified in Annex 1 No. 3.4.3, 4 and 6 of the AVV Mineralwasser must be submitted by each tapping point.
Inform your responsible veterinary and food inspection office.
Your application for official recognition of a natural mineral water should be sent to the Ministry for Climate Protection, Agriculture, Rural Areas and the Environment. A written, informal application must be submitted for this purpose. The application documents to be submitted must be enclosed in triplicate.
The documents submitted will be comprehensively reviewed and assessed by experts. This includes a joint on-site inspection by the licensing authority with the responsible veterinary and food monitoring office and the State Office for Agriculture, Food Safety and Fisheries M-V.
You will then receive the official recognition of the natural mineral water by post or, if applicable, a notice of rejection of your application.
The Federal Office for Food Safety and Consumer Protection (BVL) will be notified of the official recognition.
Up to three months from completion of the application documents, depending on the complexity of the process.
