Would you like to collect non-profit or commercially recyclable waste, so-called recyclables, from private households? Then you must notify the competent authority at least three months before the start of collection.

Non-profit and commercial collections of recyclable waste, so-called recyclable materials from private households, must be notified at least three months before the start of the collection. Street or container collections of textiles and shoes, for example, as well as waste paper collection points, must be notified.

The collection may be prohibited, limited or subject to conditions by the competent authority.

  • Recyclable materials from private households must be handed over. This means that they must be handed over to the public waste disposal authorities.
  • The commercial or non-profit collection of recyclable materials (recyclable waste) is only permitted if this has been reported to the responsible authority.
  • Notified collections may be prohibited or restricted by the competent authority.
  • Mixed waste from private households may not be collected commercially or on a non-profit basis (e.g. bulky waste).

Electronic waste (defective old electrical appliances) must be returned to the public waste disposal authorities or dealers who are obliged to take it back.

Erforderliche Unterlagen

  • Information on the size and organization of the collection company,
  • information on the type, scope and duration, in particular the maximum possible scope and minimum duration of the collection,
  • information on the type, quantity and whereabouts of the waste to be recycled,
  • a description of the recovery routes planned within the notified period, including the measures required to ensure their capacity, and
  • a description of how the proper and safe recovery of the collected waste will be ensured.

Voraussetzungen

The purpose must be the collection of waste from private households for commercial or non-profit purposes.

Collectors, transporters, dealers and brokers of waste must notify the competent authority of the activities of their business before commencing operations, unless the business has a permit in accordance with Section 54 (1). The confirmation of the notification or the permit must be attached to the notification.

The collection may not conflict with an overriding public interest.

Kosten

  • A time-based fee is charged for the examination of a notification, up to a maximum of EUR 3,500.00
  • This fee is offset in full against the fee for a possible order, provided that the examination of the notification
    • an order is issued in accordance with Section 18 (5) KrWG (fee based on time spent, maximum EUR 6,500.00) or
    • an order is issued in accordance with Section 18 (6) sentences 1 or 3 KrWG (fee based on time spent, maximum EUR 6,500.00).

Verfahrensablauf

  • As a provider of non-profit and commercial waste collections, submit the notification of your intended collection activity together with the required documents at least three months before the intended start of the collection.
  • The competent authority will examine the notification and may issue orders, such as limiting, imposing conditions on or prohibiting the collection.

Anyone who fails to notify a charitable or commercial collection, or fails to notify it correctly or on time, is committing an administrative offense. This can be punished with a fine of up to EUR 10,000.00.
