§ Section 24 (2) of the Landfill Ordinance (DepV) in conjunction with Section 5 (3) No. 1 of the Federal Immission Control Act (BImSchG)

If you wish to act as an expert or surveyor for long-term storage facilities in accordance with the Landfill Ordinance, you must be designated as such by the competent authority.

If there is a concern that, after decommissioning of the long-term storage facility, the facility or the facility property may cause harmful effects on the environment or other hazards, significant disadvantages and significant nuisances for the general public and the neighborhood, the operator shall, at the request of the competent authority, have an expert appointed in agreement with the competent authority verify whether the requirements pursuant to Section 5 (3) No. 1 of the Federal Immission Control Act are met. The expert must be officially recognized to perform these activities.
Procedures in accordance with this provision can be handled by a single body.

• Identity card or passport with confirmation of registration
• Written informal application, including excerpt from the commercial register/register of traders
• Description of the control and monitoring methods used
• Proof of the required expertise for the activity to be performed
• Documents to substantiate independence and reliability (simple certificate of good conduct)
• Description of the technical equipment or contracts for the use of external equipment

An Expert may be appointed if he has the required expertise, independence, reliability and technical equipment.
When examining the application for the designation of the Expert, evidence from another member state of the European Union or another state party to the Agreement on the European Economic Area shall be deemed equivalent to domestic evidence if it is evident from it that the applicant meets the relevant requirements of Paragraph 2, Sentence 1 or the essentially comparable requirements of the issuing state on the basis of their objective. Corresponding evidence shall be submitted to the competent authority in the original or as a copy prior to commencement of the activity. A certification of the copy as well as a certified German translation may be required.

• The fees are calculated according to the time spent.

The administrative procedure consists of the following steps:

• Written application for examination of the application by the responsible authority
• Possibly additional request for documents
• Decision-Notification of the expert

The examination of the application for notification of a body must be completed within three months; Section 42a (2) sentences 2 to 4 of the Administrative Procedure Act (deemed approval after expiry of deadline) shall apply.

The procedure for designating an expert must be completed before the start of the activity.
