You would like to build, operate or substantially change a wastewater treatment plant? Then this project is subject to approval under certain conditions.
The construction, operation and substantial modification of a wastewater treatment plant shall require a permit if
- the plant is subject to an obligation to carry out an environmental impact assessment under the Environmental Impact Assessment Act, or
- the plant treats wastewater which
(a) originates from installations pursuant to section 3 of the Ordinance on Installations Requiring a Permit, the permit requirement for which does not extend to the wastewater treatment plant pursuant to section 1(2) of the Ordinance on Installations Requiring a Permit; and
b) does not fall under Council Directive 91/271/EEC of 21 May 1991 concerning urban wastewater treatment (OJ L 135, 30.5.1991, p. 40), as last amended by Regulation (EC) No. 1137/2008 (OJ L 311, 21.11.2008, p. 1), or
- the plant treats waste water which
a) originates from a landfill within the meaning of Section 3(27) of the Closed Substance Cycle Waste Management Act with a reception capacity of at least 10 tonnes per day or with a total capacity of at least 25,000 tonnes, excluding landfills for inert waste, provided that the approval of the landfill does not extend to the facility, and
(b) does not fall within the scope of Directive 91/271/EEC.

Wastewater facilities must be constructed, operated and maintained in such a way that the requirements for wastewater disposal are met. In addition, wastewater treatment plants within the meaning of Section 60, Paragraph 3, Sentence 1, Numbers 2 and 3 of the Water Resources Act must be constructed, operated and maintained in accordance with the state of the art.
The permit shall be refused if the above-mentioned requirements or other regulations under public law cannot be complied with, even by means of ancillary provisions.
Permits for wastewater treatment plants are issued subject to costs (fees, expenses).
The administrative fees are based on the Water Management Costs Ordinance M-V, tariff item 214 (EUR 250.00 to 30,000).
The processing time depends on the quality and volume of the applications and documents submitted.
None. Timely application prior to construction, operation or substantial modification of a wastewater treatment plant is required.
A decision on the application for a permit for wastewater treatment plants pursuant to Section 60 (3), first sentence, numbers 2 and 3 of the Federal Water Act shall be taken within a period of seven months after receipt of the application and the documents to be submitted. The competent authority may extend the period if this is necessary due to the difficulty of the examination or for reasons attributable to the applicant.

The construction, operation and substantial modification of a wastewater treatment plant require a permit if the plant is subject to an obligation to conduct an environmental impact assessment under the Environmental Impact Assessment Act or if the plant treats wastewater that falls under certain criteria (cf. Section 60 (3) of the Water Resources Act Nos. 2 and 3).

In Mecklenburg-Western Pomerania, the State Office for the Environment, Nature Conservation and Geology is responsible for approving wastewater treatment plants in accordance with Section 60 (3) of the Federal Water Act (WHG) pursuant to Section 107 (3) No. 3 of the Water Act of the State of M-V (LWaG).
