If you have carried out all the necessary measures during the closure phase of the landfill or landfill section, you must apply to the competent authority for final closure to be established.

The closure of a landfill must be notified to the competent authority without delay.

After carrying out the necessary measures for the construction of a surface sealing system as well as the recultivation, you apply to the responsible authority for the determination of the final closure. This determination is made by means of an acceptance of the individual landfill sections as well as the associated technical equipment.

The closure of a landfill must be notified to the competent authority without delay. With the notification, documents on the intended closure or recultivation of the landfill site are to be submitted and the surface sealing is to be constructed on this basis. Insofar as the original approval notice for the landfill does not yet contain any specifications in this respect, the competent authority shall specify the type and manner of recultivation/surface sealing in an order pursuant to § 40 Para. 2.
After completion and official acceptance of the construction work for the creation of the surface sealing, the competent authority determines the completion of the closure. This completes the final closure of the landfill. From this point on, recommissioning is only possible after renewed approval of landfill operation. From this point on, the landfill is in the aftercare phase.
After an appropriate period of time (cf. § 18 Para. 2 Sentence 5), it is possible to release a landfill from the aftercare phase upon application by the landfill operator. For this purpose, the criteria according to § 11 para. 2 DepV must be fulfilled.
The decisions of the authorities pursuant to Section 40 KrWG are not subject to procedural requirements as are applicable to the approval pursuant to Section 35 KrWG.

A prerequisite for the final closure of a landfill is that a surface sealing system has been constructed in accordance with the state of the art and has been accepted by the responsible waste management authority.
A prerequisite for determining that the aftercare of a landfill has been completed is that all necessary measures have been taken to prevent any impairment of the public welfare. This is regularly fulfilled when the documents required under point 8 are available with a positive result.
